महोदया,
हम आपका ध्यान विषयक के सन्दर्भ मे आकृष्ट कराना चाहुंगा, नवोदय विद्ध्यालय की स्थापना एक महान उपलब्धि मानी जा रही थी, जब विकास पुरूष व भूतपुर्व प्रधानमंत्री स्व0 राजीव गान्धी जी ने इसे वंचितो और दलितो, गरीबो की उत्कृष्ट शिक्षा के लिए मानव विकास का सपना देंखे थे ! यह सच होता नज़र भी आया, लेकिन एक दशक के आस - पास से कई हज़ार लोंगो की भावनाओ से खेला जाने लगा,इसकी बजट घटायी गयी, महगाई बढती गयी ! प्रशासनिक स्थिति केवल विद्यार्थियो को डराने और शोषण करने के लिए उपयोग होने लंगी, इन सभी बातो को देखते हुए जिलाधिकारी को सचिव या अध्यक्ष बनाया गया, फिर भी स्थिति मे सुधार न आकर, दिन पर दिन यहा अराजकता और मनमानी होती गयी, यह पूरे नवोदय विध्द्यालय समिति की स्थिति है !
वही पकरीवरावा का रेवार स्थित नवोदय जो नवादा जनपद के बिहार राज्य मे है, सभी के सामने सच्चाई लेकर आयी है, दशको से बच्चे व्यवस्था के शोषण के शिकार है !
बोलने पर बच्चो को निकाल देने की धमकी या निकाल दिया जाता है,
एक तरफ सर्व शिक्षा अभियान को सफल बनाने के लिए सबकुछ किया जा रहा है, दूसरी तरफ एक स्थापित विध्द्या केन्द्र को उजाडने की साजिश, जहा से निकले कई छात्र आज देश की विकास मे सहयोग बढ्चढ के कर रहे है !
महोदय अगर यही स्थिति बनी रही तो वह दिन दूर नही जब यह भी उपेक्षाओ को झेलते हुए कई नामी गिरामी विध्या मन्दिरो की तरह इतिहास की तरह सुनी व बोली जायेगी, जहा 80 प्रतिशत बच्चे दलित, वंचित और पिछ्डी जाति से सम्बन्ध रखते है !

अत: महोदया से निवेदन है कि मामले की गम्भीरता को लेते हुए न्यायोचित दिशा निर्देश देने की कृपा करे !

नवोदय विद्यालय में कुव्यवस्था देख भड़के सांसद

पकरीबरावां (नवादा), निज प्रतिनिधि : जवाहर नवोदय विद्यालय,रेवार में व्याप्त कुव्यस्था को देख सांसद डा. भोला सिंह ऐसे भड़के कि प्राचार्य को छात्रों के लिये यमराज बता दिया। शुक्रवार को क्षेत्र भ्रमण के क्रम में वे अचानक उक्त विद्यालय पहुंचे गये। वहां की व्यवस्था देख सांसद भौंचक रह गये। छात्र-छात्राओं के भोजन के लिये बन रहे चावल, दाल व सब्जी की गुणवत्ता से लेकर रहन-सहन व शौचालय की व्यवस्था देख क्षुब्ध हुए सांसद अपनी नाराजगी को छुपा नहीं पाये। और मौके पर ही प्राचार्य की क्लास लगा दी।

निरीक्षण उपरांत पत्रकारों से मुखातिब सांसद ने कहा कि विद्यालय बच्चों के लिये कारावास की भांति है। जेल में भी बंदियों को इससे बेहतर सुविधाएं मिलती है। भोजन में घटिया किस्म के सामग्रियों के इस्तेमाल को घोर आपत्तिजनक बताते हुए कहा कि प्राचार्य शिक्षक नहीं होते इनके साथ कुछ और ही व्यवहार किया जाता। छात्रावास के इर्द-गिर्द जन्मे घास-फूस से जंगल सा नजारा देख कहा कि अगर इस विद्यालय के छात्र-छात्राएं जी भी रहे हैं तो वे भगवान भरोसे।

दो दशक से भी ज्यादा समय इस विद्यालय का हो चुका है। परन्तु पहली बार सांसद का औचक निरीक्षण हुआ। और निरीक्षण में विद्यालय की तमाम खामियां सामने आ गयी। सांसद आश्चर्य में थे कि विद्यालय संचालन के लिये विगत दो वषरें से डीएम द्वारा कोई बैठक ही नहीं की गयी। उन्होंने विद्यालय में अनियमितता पर कार्रवाई के लिए डीएम को पत्र लिखने की बात कही। बावजूद सुधार नहीं होने पर लोकसभा में इस मामले को उठाने की बात कही।

बता दें कि विद्यालय प्राचार्य की शिकायतें छात्रों द्वारा पूर्व में भी की जाती रही है। कई बार छात्र-छात्राएं आंदोलन पर उतारू हुई। विद्यालय से छात्र भागे भी। हर बार व्यवस्था में सुधार का आश्वासन अथवा विद्यालय से निष्कासन का भय दिखाकर छात्रों को दबाया जाता रहा।

05 नवम्बर, 2011 से आज 15 नवम्बर, 2011 बितने वाला है, लेकिन अभी तक किसी भी प्रकार की त्वरित कार्यवाही दोषी व अवैध हिरासत मे रखने वाले पुलिस कर्मी पर नही की गयी ! यहा डी0के0 बसु बनाम प0 बंगाल मे माननीय उच्चतम न्यायालय - भारत द्वार दिये फैसले का सरासर उल्लघन है !

अत: महोदय से निवेदन है कि उक्त प्रकरण को गम्भीरता से लेते हुये त्वरित आदेश / निर्देश देने की कृपा करे, ताकि मामला लम्बी प्रक्रिया का शिकार न हो जाए, पीडित के साथ न्याय हो और गवाह को सुरक्षा प्रदान कराने की कृपा करे !

महोदय,
हम आपका ध्यान लखीमपुर खीरी, उत्तर प्रदेश के ढखेरवा पुलिस चौकी की ओर ध्यान आकृष्ट कराना चाहुगा, जहा शनिवार की रात हिरासत मे रखकर युवा दुकानदार रंजीत मौर्या, पुत्र - सुरज प्रसाद, निवासी - लक्खनपुरवा को पुलिस ने इतनी बेरहमी से पीटा की उसकी मौत हो गयी, पोस्टमार्टम रिपोर्ट मे भी पुष्टि हुई है !

मौत को आत्महत्या बताने के लिए पुलिस ने मृतक रंजीत के शव को पुलिस चौकी मे लगे पंखे से लटका दिया ! मृतक के परिजन जब इस सन्दर्भ मे पूछ - ताछ कर रहे थे तब सम्बन्धित पुलिस चौकी के पुलिसकर्मियो ने मृतक के भाभी, माता जी तक को लाठियो से पीट डाला ! यह खबर दैनिक अखबार मे छापा गया, संलग्न है - http://epaper.amarujala.com/svww_zoomart.php?Artname=20111114a_013190006&ileft=690&itop=87&zoomRatio=276&AN=20111114a_013190006

हिरासत मे हिंसा की बढ्ती घटनाओ को देखते हुए, माननीय उच्चतम न्यायालय - भारत ने डी0के0 बसु बनाम प0 बंगाल सरकार, (1997), दिये निर्देश का सरासर उल्लघन हो रहा है !

अत: महोदय से निवेदन है कि उक्त प्रकरण को गम्भीरता से लेते हुये त्वरित आदेश / निर्देश देने की कृपा करे, ताकि मामला लम्बी प्रक्रिया का शिकार न हो जाए, गवाह को सुरक्षा प्रदान कराने और पीडित परिजन को न्याय दिलाने के साथ ही साथ कम से कम 5 लाख रूपया की मुआवजा प्रदान कराने की कृपा करे !

महोदय,

हम आपका ध्यान जेलों में धड़ाधड़ हो रही मौतें की ओर आकृष्ट कराना चाहुंगा, जिस ओर शासन बेफिक्र है।

कैदियों की मौतों की मजिस्ट्रेटी व न्यायिक जांच की रिपोर्टे लापरवाही की पोल खोल चुकी हैं। जेल प्रशासन बंदी रक्षकों के सिर ठीकरा फोड़ निवृत्त हो जा रहा है। जेलों में मृत्यु दर बढ़ने पर मानवाधिकार व बंदियों के झंडाबरदार भी चुप्पी साधे पड़े हैं।

जांच रिपोर्टे बताती हैं कि एक ओर तो तमाम माननीय बेवजह अस्पतालों में पहुंच जाते हैं और दूसरी ओर गरीब बंदी इलाज के अभाव में एड़ियां रगड़ कर दम तोड़ देते हैं। इन रिपोर्टो से पता चलता है कि जेलों में अधिकतर मौतें ठीक उसी दिन हो जाती हैं जिस दिन बंदी को जिला-मंडलीय अस्पताल में भर्ती किया जाता है। इतना ही नहीं अक्सर बंदी जेल में ही मर जाता है। उसे मरी हालत में अस्पताल पहुंचा कर जेल प्रशासन चुप्पी साध लेता है।

कम से कम सेंट्रल जेल में बंद रहे मालवीयनगर, बाजारखाला (लखनऊ) के कैदी रवि प्रताप शर्मा की मौत की रिपोर्ट तो यही कहानी बयां कर रही है। रवि की मौत की मजिस्ट्रेटी जांच में जेल प्रशासन को सतर्कता न बरतने का दोषी बताया गया है लेकिन ताज्जुब यह कि इस मामले में तत्कालीन प्रधान बंदी रक्षक कमलेश कुमार, नंद किशोर व बंदी रक्षक प्रभु नारायण पांडेय के खिलाफ तो परिनिंदा दंड की कार्रवाई स्थानीय स्तर से हो गयी लेकिन जेलर आरसी श्रीवास्तव, डिप्टी जेलर दीपेंद्र यादव, नीरज श्रीवास्तव के खिलाफ सात साल बाद भी कार्रवाई नहीं हो सकी है। यह शासन स्तर से होनी है।

सेंट्रल जेल में दो वर्ष पूर्व हुई सैंतीस वर्षीय सजायाफ्ता मुजरिम मोहम्मद आसिफ की मौत की हाल ही में दाखिल न्यायिक जांच की रिपोर्ट हालांकि किसी को दोषी तो नहीं ठहराती लेकिन बंदियों के इलाज में देरी के मौत का सबब होने की ओर संकेत जरूर करती है। तत्कालीन जेलर एसएन द्विवेदी के बयान में यह बात आयी है कि बैरक में बंद अन्य कैदियों ने आसिफ की मौत के बाद नाराजगी के चलते बैरक बंद कर लिया था।

सेंट्रल जेल में ही हुई चकिया (चंदौली) के जहूर की मौत की मजिस्ट्रेटी जांच की रिपोर्ट में कहा गया है कि 2000 रुपये न देने पर इलाज की व्यवस्था नहीं की गयी। इतना ही नहीं रुपये न दे पाने की बात कहने के बाद उसे एक इंजेक्शन लगाया गया जिसके बाद हिचकी आयी और वह मर गया। यह बात हत्या के जुर्म में साथ ही जेल में बंद रहे उसके भाई शकूर खां ने कही है। इसमें उसने जेलर पर मुंह न खोलने के लिए धमकी देने का भी आरोप लगाया लेकिन उसकी बातें अनसुनी कर दी गयीं। सेंट्रल जेल में बंद रहे देवरिया जिले के कैदी छबीला की जांच रिपोर्ट बताती है कि उसकी तबीयत 1 फरवरी 2010 को खराब हुई लेकिन उसे 4 फरवरी को पं. दीनदयाल उपाध्याय अस्पताल ले जाया गया। वहां पहुंचते ही डॉक्टरों ने छबीला को मृत घोषित कर दिया।

जेलों में बढ़ती मौतों और जवाबदेही का सवाल छिड़ने पर अफसर एक-दूसरे के पाले में गेंद डाल देते हैं। डॉक्टरों की कमी और अक्सर गारद न मिलने से चिकित्सा प्रबंध ठीक नहीं हैं कह कर आफिसर पल्ला झाड. लेते है। चौंकाने वाला तथ्य यह है कि जब सेंट्रल जेल में मात्र 1200 कैदी थे तब 3 डॉक्टर थे। अब कैदी 2400 से ज्यादा और डॉक्टर मात्र 1 है। इस कमी की भरपाई स्वास्थ्य विभाग के जिम्मे है लेकिन वह मौन है। जेल अफसर चिट्ठी लिखते हैं लेकिन महकमे की नींद नहीं टूटती। जेल कर्मियों को लेकर उठे सवालों पर वह कन्नी काट गये।

अत: महोदय से निवेदन है कि मामला मे त्वरित हस्क्षेप करते हुये मृतक कैदियो के परिजनो को मुआवजा प्रदान कराते हुये शासन - प्रशासन पर न्यायोचित कार्यवाही करने की कृपा करे !

वाराणसी, नगर संवाददाता : जेलों में धड़ाधड़ मौतें हो रही हैं, शासन बेफिक्र है। कैदियों की मौतों की मजिस्ट्रेटी व न्यायिक जांच की रिपोर्टे लापरवाही की पोल खोल चुकी हैं। जेल प्रशासन बंदी रक्षकों के सिर ठीकरा फोड़ निवृत्त हो जा रहा है। जेलों में मृत्यु दर बढ़ने पर मानवाधिकार व बंदियों के झंडाबरदार भी चुप्पी साधे पड़े हैं।

क्या कहते हैं अफसर

जेलों में बढ़ती मौतों और जवाबदेही का सवाल छिड़ने पर अफसर एक-दूसरे के पाले में गेंद डाल देते हैं। डीआईजी जेल वीके जैन कहते हैं-डॉक्टरों की कमी और अक्सर गारद न मिलने से चिकित्सा प्रबंध ठीक नहीं हैं। चौंकाने वाला तथ्य यह है कि जब सेंट्रल जेल में मात्र 1200 कैदी थे तब 3 डॉक्टर थे। अब कैदी 2400 से ज्यादा और डॉक्टर मात्र 1 है। इस कमी की भरपाई स्वास्थ्य विभाग के जिम्मे है लेकिन वह मौन है। जेल अफसर चिट्ठी लिखते हैं लेकिन महकमे की नींद नहीं टूटती। जेल कर्मियों को लेकर उठे सवालों पर वह कन्नी काट गये।

महोदय,

हम आपका ध्यान मिर्जामुराद (वाराणसी) उत्तरप्रदेश थाने में सिपाही के द्वारा मासूम के साथ दुराचार की दुसरी घटना के सन्दर्भ मे आकृष्ट कराना चाहूंगा, जहा चार माह से रोक कर रखे गये मूक बधिर मासूम बालक के साथ गुरुवार की रात दुष्कर्म किया गया। पुलिस इस मामले को दबाने की कोशिश में जुटी है। इस मामले को लेकर क्षेत्र में जबर्दस्त तनाव की स्थिति बनी हुई है !

दुराचार का शिकार बालक चार माह पहले पुलिस को मिला था। पुलिस ने उसे चाइल्ड लाइन के हवाले करने की बजाय थाने में रख कर बेगारी शुरू करा दी। वह पुलिसवालों का चाय-पानी लाता और जो मिल जाता खा-पीकर सो जाता था।

गुरुवार की रात शराब के नशे में धुत एक सिपाही थाने पहुंचा और सो रहे बालक को उठाकर परिसर में ही दुराचार किया। इस थाने में पहले भी एक बालक से दुराचार की घटना हो चुकी है। नीचे से ऊपर तक के अफसर पूरे मामले से अनभिज्ञता जता रहे हैं।

अत: महोदय से निवेदन है कि मामला की गम्भीरता को देखते हुए त्वरित कानूनी कार्यवाही के साथ उक्त थाने पर बाल मज़दूरी कराने की मुकदमा भी चलायी जाए, तथा पीडि.त बालक का पुनर्वासन कराने की कृपा करे !

-बड़ा सवाल : क्यों नहीं भेजा चाइल्ड लाइन, महकमा सकते में

वाराणसी, जागरण टीम : मिर्जामुराद थाने में चार माह से रोक कर रखे गये मूक बधिर मासूम बालक के साथ गुरुवार की रात दुष्कर्म किया। पुलिस इस मामले को दबाने की कोशिश में जुटी रही। इस मामले को लेकर क्षेत्र में जबर्दस्त सुगबुगाहट रही।

हमारे मिर्जामुराद प्रतिनिधि ने बताया कि दुराचार का शिकार बालक चार माह पहले पुलिस को मिला था। पुलिस ने उसे चाइल्ड लाइन के हवाले करने की बजाय थाने में रख कर बेगारी शुरू करा दी। वह पुलिसवालों का चाय-पानी लाता और जो मिल जाता खा-पीकर सो जाता था।

सूत्रों ने बताया कि गुरुवार की रात शराब के नशे में धुत एक सिपाही थाने पहुंचा और सो रहे बालक को उठाकर परिसर में ही दुराचार किया। इसकी जानकारी कानो- कान थाना प्रमुख के साथ ही सिपाहियों और आसपास के ग्रामीणों को भी हो गयी। हालात की नजाकत को भांपते हुए एसओ धर्मवीर सिंह ने शिनाख्त परेड भी करायी लेकिन बात इससे आगे नहीं बढ़ पायी।

बताया जाता है कि इस थाने में पहले भी एक बालक से दुराचार की घटना हो चुकी है। इसी बीच नया मामला सामने आ जाने से पुलिस सकते में आ गयी है। नीचे से ऊपर तक के अफसर पूरे मामले से अनभिज्ञता जता रहे हैं।)

महोदय,

हम आपका ध्यान झारखण्ड के धनबाद जनपद स्थित चास मण्डलकारा की ओर आकर्षित कराना चाहुगा, जहा संतोष सिंह नामक कैदी निरूध्द है, जिसे जेल के जेलर और जमादार के द्वारा पैसा नही देने पर जान से मारने की धमकी दी जा रही है !

इससे पहले भी जहागीर नामक कैदी का देहांत हो चुकी है, जिसमे उक्त दोनो जेल कर्मचारी का नाम आया है और मामला भी दर्ज किया गया है, लेकिन अभी तक न्याय नही हो पायी ! अभी एक घटना को अंजाम देने वाले दुसरे कैदी को भी मानसिक शोषण के साथ जान से मारने के फिराक मे है ! (संलग्नक - 1, अखबार की प्रतिलिपि)

कैदी के परिवार वाले जब जान माल की सुरक्षा हेतु गुहार लगये तब जाकर कैदी द्वारा 15 दिनो से अनशन पर रहने की बात सामने आयी, जेल प्रशासन इस मामला को भी दबाये थी !

इससे साबित होता है कि जेल मे जेलर और जमादार का सामंती बोलबाला है, कानून मे किसी भी प्रकार का आस्था नही है ! इनकी इस रवैया से कैदी का हालात गम्भीर बनी हुयी है,

अत: महोदय से निवेदन है कि मामला मे त्वरित हस्क्षेप करते हुये मृतक कैदी जहागीर के मामला मे की गयी पोस्ट्मार्टम की विडियोग्राफी करवायी गयी थी की नही और दर्ज मामले मे कार्यवाही हुयी है की नही की जांच की जाय एवम संतोष सिंह को सुरक्षा के साथ दोषी जेल प्रशासन पर न्यायोचित कार्यवाही करने की कृपा करे !

हम आपका ध्यान झारखण्ड के लोहरदगा स्थित हंटरगंज के मुर्की तोडार पंचायत के ठकरू उराव (साल- 60 ) व उनकी पत्नी तेतरी उराव (साल-55) तथा जबडा के चिरैयाटाड. के जीतन मान्झी व उनकी पत्नी कपूरवा देवी की हत्या डायन बताकर की गयी, इस वर्ष लगभग 150 मामले इस तरह के सम्बन्धित राज्य मे घट चुका है, पुलिस थाने मे 1200 मामले दर्ज भी है, फिर भी नर बलि रुकने का नाम नही ले रही है, इस कुप्रथा से राज्य के कई जिले प्रभावित है!

अत: महोदय से निवेदन है कि उक्त मामले मे कार्यवाही करते हुये दिशा निर्देश जारी करने की कृपा करे!

Ask India to help stop the bloodshed in Syria

It has been over four months since the beginning of largely peaceful protests in Syria calling for political reform and for the Syrian President to step down. The Syrian authorities’ response to their people’s demands has so far been brutal.

According to Amnesty International’s research, the human rights violations committed by the Syrian security forces and army since mass protests began in mid-March include unlawful killings and torture. They appear to have been committed as part of a widespread - as well as systematic - attack on the civilian population and, in some cases, to amount to crimes against humanity.

That is why Amnesty International has called on the UN Security Council to refer the situation in Syria to the International Criminal Court (ICC), to impose an arms embargo and to freeze the assets abroad of the Syrian President and his senior associates.

So far the UN Security Council has been silent on Syria – failing to take action to help protect peaceful dissent in the country.

Some members of the Council have introduced a resolution on Syria which could be a first step towards a referral to the ICC. However, voting on the resolution is currently blocked by six other members. We believe that, three of those six, Brazil, South Africa and India, could be persuaded to change their position with sufficient international pressure.

Brazil, South Africa and India aspire to become permanent members of the UN Security Council and, as such, we believe that they have an increasing responsibility to try to bring an end to the violent crackdown in Syria. Please sign this petition to help ensure that Brazil, South Africa and India do not shy away from their responsibilities. As an Indian you need to pressure your government to change its position. Despite an obligation under international law to treat anyone below 18 as a child, police in Jammu and Kashmir (J&K) continue to jail 16- and 17-year old boys as adults!

17-year old Murtaza Manzoor was detained without charge by the police in January 2011. He was held for nearly four months in a prison that had no special facilities for children.

Although India has amended its national juvenile justice law to make it consistent with the UN Convention on the Rights of the Child, the law in the state of J&K has not yet been updated.

Murtaza is not alone. Many other boys aged between 16 and 18 years are falling through the cracks in J&K’s juvenile justice laws and being treated as adults.

The Chief Minister of J&K, Omar Abdullah, has recognised the need for reform in this area. To make sure these reforms happen, we need you to urge the Chief Minister to begin by amending the Jammu and Kashmir Juvenile Justice Act (JKJJA) in the 2011 Monsoon session of the J&K Assembly.

When teenage boys turn 16 in Jammu and Kashmir (J&K) in India they suddenly face a new threat. If they get arrested, they are treated as adults while according to international law only those above 18 should be.

Raheel Khursheed, who recently joined an Amnesty International Twitter campaign to demand the release of a teenager said, “The government has to decide whether the approach of talking to these young people should be humane or whether they want to go down as a government that uses legal brutality.”

According to the Jammu and Kashmir Juvenile Justice Act (JKJJA) teenage boys above 16 are adults and the government routinely locks them up in adult prisons in harsh conditions. There is a real need for reform in the area of juvenile justice and this has been recognised by the J&K Chief Minister, Omar Abdullah himself.

A teenage boy, Murtaza Manzoor, was taken into custody by police immediately after being released from administrative detention on 18 May, and is at risk of a repeat administrative detention order.
Murtaza Manzoor had been arrested on 21 January by police in Srinagar, the capital of Jammu and Kashmir. He was held in administrative detention under the Public Safety Act (PSA) from 8 February till 18 May.
On 13 May the High Court of Jammu and Kashmir found the detention unlawful and ordered his release. On 18 May, instead of being released to his father who was waiting outside the Kot Bhalwal Jail, Murtaza Manzoor was escorted from the prison by four policemen of a specialist counter-insurgency team and taken to the Joint Interrogation Centre at Jammu.
The police officials did not give his family any information on the alleged offences for which Murtaza Manzoor was being held– his detention may be without legal basis. The police officers however told his father that Murtaza Manzoor would be kept at the interrogation centre for a few days before being handed over to a police station in Srinagar. It is likely that a repeat administrative detention order will be passed to further hold Murtaza Manzoor under the PSA.
Murtaza Manzoor is aged 17, but he is being treated as an adult as the laws of Jammu and Kashmir define boys above the age of 16 as adults, in contravention of Indian law and the UN Convention on the Rights of the Child.
The Chief Minister of Jammu and Kashmir has previously said that the state’s juvenile justice laws will be amended to make them consistent with international law and standards.

Murtaza Manzoor has been held in administrative detention since 8 February by police in Jammu and Kashmir, India. His official birth certificate states that he is only 17 years old.
Murtaza Manzoor was arrested on 21 January by police in Srinagar, the capital of Jammu and Kashmir. He was arrested in relation to a case from June 2010 on allegations of attempted murder, assault and rioting. According to the police, he is an “incorrigible antisocial element” who was leading a protest march that resulted in protestors pelting police with stones.
On 8 February the police decided to hold Murtaza Manzoor, under the Public Safety Act, as they feared that he would be released on bail in the criminal case against him. Police documents relating to his arrest and detention give no indication of his age, but his family members gave Amnesty International a copy of his official certificate of birth (from the Office of the Registrar of Births and Deaths, Government of Jammu and Kashmir) that shows that he is only 17 years old.
Murtaza Manzoor has been held at Kot Bhalwal Jail in Jammu, nearly 300 km away from his home, since 8 February. The prison does not have any special facilities for children and provision of health care is limited. Manzoor’s father is an auto rickshaw driver in Srinagar and the family is struggling to meet the expenses for jail visits and legal proceedings for his release.

At least 322 people are reported to have been detained without trial under the provisions of the Public Safety Act in Jammu and Kashmir from January to September 2010 alone. A number of them, including children, have been detained on similar grounds of stone pelting and rioting during various protests against the Indian government throughout the summer of 2010.

The Chief Minister of Jammu and Kashmir has claimed that no children are being detained in the state, as the Jammu and Kashmir Juvenile Justice Act 1987 treats boys above the age of 16 as adults. However, the Indian Juvenile Justice (Care and Protection of Children) Act 2000 operating in the rest of the country gives the age of majority as 18 in line with the UN Convention on the Rights of the Child (CRC).

When considering India’s second periodic report under the CRC, the Committee on the Rights of the Child specifically recommended the application of the updated national law to the state of Jammu and Kashmir. Earlier this week, the Director, Social Welfare Department Hilal Ahmad Parray told the Greater Kashmir newspaper that a proposal to amend the Juvenile Justice Act was under preparation and that the age would be amended on a priority basis.

डॉ. लेनिन रघुवंशी पूर्वी उत्तरप्रदेश में ग़रीब और कमज़ोर लोगों के साथ होने वाले तरह-तरह के ज़ोर-जुल्‍म की कहानियां सरोकार को भेज रहे हैं. पेश है उस श्रृंखला की चौथी किस्‍त. इस बार रामदयाल नामक एक बंधुआ मज़दूर की दास्‍तान उन्‍हीं की जुबानी :
मेरा नाम रामदयाल, उम्र-27 वर्ष, पुत्र-स्व. लोचन है। मैं ग्राम-सराय, तहसील-पिण्डरा, थाना-फूलपुर, जिला-वाराणसी (उत्तर प्रदेश) का निवासी हूँ। गाँव में हमारे बिरादरी के लगभग 60 घर हैं।
हमारी शादी 11 मार्च, 1999 में सुनीता से हुई. मेरे तीन बच्चे : दो लड़के, पुजारी, उम्र 10 वर्ष (प्राथमिक विद्यालय-देवराई में कक्षा चार में पढ़ता है) तथा विफाई, उम्र 6 वर्ष (कक्षा दो) और एक लड़की रेशम 2 साल की है।
वर्तमान में राजा भट्टा, ग्राम-उंदी से बंधुआ मजूरी से छुड़ाये जाने के बाद खेत-मजदूरी करके परिवार का भरण-पोषण कर रहा हूँ। कभी-कभी ट्रैक्टर या मिट्टी काटने की मजदूरी भी कर लेता हूँ। एक दिन में 50 रुपये मजदूरी मिलती है। जिसमें सुबह 6 बजे से दोपहरर बजे तक काम करना होता है। कभी-कभी पूरा दिन का काम मिल जाता है तो 100 रुपये की मजदूरी हो जाती है। आये दिन बेकार बैठना भी पड़ता है. दो-चार दिन तक कोई काम नहीं मिलता। किसी प्रकार गुज़र-बसर हो रहा है। मैं दाएं पैर से विक्‍लांग हूँ. इसलिए मैं बोझा नहीं उठा सकता लेकिन अन्‍य बहुत तरह के काम कर सकता हूं। मैंने साड़ी बिनने का काम भी किया है, लेकिन बिनकारी की हालात गिरने के बाद खेत-मजदूर का काम करना पड़ा।
एक दिन मेरे रिश्‍तेदार आये और राजा भट्ठा पर काम करने को कहा। बोला कि वहां का मालिक अच्छा है, ईमानदारी से मजदूरी देगा। हम पांच जोड़ी यानि दस लोग अपने बच्चों के साथ वहां काम करने गये। वहां हम लोग विश्‍वास पर काम करने गये थे। तीन महीने तक सब ठीक-ठाक रहा। एक दिन अचानक भोला की लड़की संतरा (उम्र-5 वर्ष) की तबियत खराब हो गयी। भोला मालिक बब्लू सिंह से ईलाज के लिए पैसा मांगा। मालिक ने बोला, ‘पैसा नहीं है, चल काम कर और उठ कर मारने लगा। जिससे अभी भी उसके कान से खून व मवाद आता है। उस समय भट्ठा मालिक शराब पिया हुआ था और दो-चार लोग उसके साथ बैठे थे।
भोला के साथ हुई घटना के बाद कुछ सोचकर हम मालिक के पास गये और बोले, ‘‘मालिक तीन दिन से बच्ची को बुखार है, कुछ पैसा दे दीजिए।’’ यह सुनकर हमें भी गाली-गलौज करके भगा दिया। हम डर से अपने निवास स्थान पर आ गये। उस समय हमें बहुत गुस्सा भी आ रहा था, लेकिन हम मजबूर थे। वहां से हम लोग भाग भी नहीं सकते थे, क्योंकि हम लोगों के लिए रखवार (निगरानी करने वाला) लगा रखा था। उन लोगों से बोला गया था कि ये लोग भागे नहीं, देखते रहना। सप्ताह भर की खुराकी मिलने के बाद लगभग 15 दिन तक हम लोगों ने वहां काम किया। इस बीच मालिक रोज़ आकर धमकाता था। कहता था, ‘‘कहीं भागे तो भट्ठा में झोंक देंगे।’’ औरतों को भद्दी-भद्दी गालियां देता था और उठाकर ले जाने की बात करता था। यह सब देख-सुनकर हमारी तकलीफ़ और ज्यादा बढ़ गयी थी। हम सोच रहे थे कि किसी तरह मौका का तलाश कर अपने गांव भाग जाए।
जब गाली-गलौच, मार-पीट का अत्याचार बहुत बढ़ गया, तब हम लोग एक दिन 3 बजे सुबह मिट्टी पाथने के बहाने साथ-साथ भाग गये। पहरेदार लोग निश्चिंत थे कि अब हम लोग नहीं भागेंगे। खेते-खेते पैदल चल कर भट्ठा से उत्तर दिशा लगभग 8 किलोमीटर दूर आयर बाजार के आगे सिंधौरा तक पत्नी व बच्चों के साथ आये। भागते समय डर भी लग रहा था कि कोई हम लोगों को पकड़ न ले। फिर भी हम लोग भगवान के सहारे भाग रहे थे। आज भी उस भट्ठे की याद आने पर शरीर के रोएं खड़े हो जाते हैं। हमारी बिरादरी में किसी के साथ ऐसा न हो।
पिण्डरा आने पर एक नदी (नंद नाला) के किनारे दो-चार पेड़ है, उसी की छांव में पूरी दोपहर हमलोग छिपे रहे। वह महीना इसी साल का अप्रैल था, तारीख याद नही आ रही है। जब शाम में अंधेरा छाने लगा तब हम लोग वहां से पूरब सरैयां गांव के बगल में रतनपुर गांव के पोखरा के पास आये। उस समय रात के लगभग 9 बजे का समय हो रहा था। गाड़ी की रोशनी देखते ही हम लोग भागने लगते थे, क्योंकि पूरे इलाके में हल्ला हो गया था कि मालिक भागने वाले मजदूरों को खोज रहा है। मालिक कपड़ा बदल-बदलकर तथा हेलमेट लगाकर हम लोगों के बारे में पूछताछ कर रहा था।
दो दिन-दो रात हम लोग पोखरा के किनारे बिताए। खेत में चलते-चलते बच्चों के पांव फुल गये थे। खाने के लिए कुछ नहीं था, केवल पानी पीकर या कुछ हल्का मिठा खाकर हमने गुजारा किया। पीने के लिए पोखरा का पानी ही था। वहीं ताल पर छुपे-छुपे एस ओ और एस डी एम साहब के फोन नम्बर की जानकारी लेकर फोन किया। लेकिन कोई सहायता के लिए नहीं आया। तब हमने ‘मानवाधिकार जन निगरानी समिति’ के मंगला भैया को फोन लगाया। उन्होंने हम लोगों को ढ़ाढस बंधाया और बोला कि आपलोग तहसील दिवस में यहां आ जाओ, उस दिन मंगलवार था। हम बोले, ‘‘हम नही आ पायेंगे, डर है कि कहीं मालिक देख ले और पकड़कर ले जाए, मार-पीट करे।’’ तब उन्होंने कहा-‘‘वही रहो, हम आते हैं।’’ वे आये और तहसील पर हम सारे लोगों ने साहब को आवेदन दिया।
आवेदन देते समय मालिक के रिश्‍तेदार (कनकपुर के लोग) तथा अन्य लोग हमें डराने-धमकाने लगे, लेकिन हम लोगों ने हिम्मत जुटाकर सभी जगह आवेदन दिया। फिर रोड से नहीं जाकर ताले-ताले पकड़कर घर गये। घर पहुँचने के बाद भी हम लोग डरे हुये थे और दो-तीन लोग पहरेदारी कर रहे थे कि कही से कोई आ न धमके।
उसके बाद भी महीना भर मलिक हमलोगों को खोजते रहा। जब वह बस्ती की ओर गाड़ी से आता था, हम लोग भाग जाते थे। उसके चले जाने के बाद ही फिर बस्ती में आते थे। हम लोगों में से दो आदमी यही देखने में लगे रहते थे कि मालिक का गाड़ी आ रही है कि नहीं। अगर कभी बात निकलती है या सोचने लगते हैं तब सर में दर्द होने लगता है और चक्कर भी आने लगता है। सुबह उठने के साथ ही पुरी बात दिमाग़ में घुमने लगता है। मालिक के द्वारा कही बातें या उसे देखते ही हमारा शरीर सुन्न हो जाता है। आज भी आपसे बात करते हुए वैसा ही लग रहा है।
उस एक महीने में जीवन गुजाराना बहुत तकलीफदेह था। काम करने के लिए दूर जाना पड़ता था और उसी मजदूरी से कई दिन गुजारा करना पड़ता था। हम लोगों की जिंदगी क्या ऐसी ही रहेगी, हम लोगों को सुनने वाला कोई नहीं है? हम लोग जिलाधिकारी (वाराणसी) के बंगले पर गये। आवेदन देने के बाद भी मालिक हम लोगों को ढ़ूंढ रहा था। उसके बाद एक दिन तहसील दिवस पर हम लोगों की औरतें जब जिलाधिकारी को आवेदन देने जा रही थी, तभी वही पर बैठा एस ओ रोककर पूछा, ‘‘तुम लोग इतनी भीड़ में कहाँ जा रहे हो’’ और आवेदन ले लिया। आवेदन लेने के बाद एक अलग कमरे में हम सभी को बुलाया और पूछताछ किया। पूरी मामला जानने और भट्ठा का पता लेने के बाद बोला कि तुम लोग घर जाओ, हम उसको पकड़ने जा रहे है। हम लोग भी घर चले आए। तब से मालिक हमलोगों को ढूढ़ना कम कर दिया। उस दौरान हमें रात में नींद नहीं आती थी, नींद आने पर सपना आता था कि मालिक हथियार लेकर दौड़ा रहा है हम भागने की कोशिश कर रहे हैं, लेकिन भाग नहीं पा रहे है। कई लोग को हदस के मारे बुखार आ गया था।
आवेदन देने के चार दिन बाद रात में लगभग 8 बजे एक मोटर साइकिल पर दो पुलिस वाले आये, उन लोगों ने औरतों से बात की और कहा, ‘‘तुम लोगों ने गलत बयान दिया है, सुलह कर लो, नहीं तो तुम साले लोग फँस जाओगे और पिटाओगे सो अलग।’’ हम लोग तो गाड़ी की रोशनी देख कर ही भाग गये थे। जब हम वापस बस्ती में आये तब महिलाओं ने सारी बात बतायी।
लेकिन यहां आने पर अभी पता चला कि संस्था के द्वारा लिखा-पढ़ी करने पर हम लोगों का मामला सुप्रीम कोर्ट में चला गया है। संस्‍था वालों ने हमें बताया है कि सुप्रीम कोर्ट के पीआइएल सेल की ओर से इस मसले पर जवाब तलब के लिए कोई नोटिस आयी है. अब हमें संतोष हुआ है और लग रहा है कि इंसाफ होगा। आज हमें भी बड़ा होने का एहसास हो रहा है। भट्ठा मालिक बोलता था कि जिलाधिकारी और बड़े-बड़े अफसर मेरे रिश्‍तेदार हैं, हमारा कोई कुछ नही बिगाड़ सकता है।
अब अच्छा लग रहा है। हम लोग भी उसको जवाब दे सकते हैं। उस पर मुकदमा दायर हो जाए तो और खुशी की बात होगी। जल्द से जल्द सुनवाई हो। हम लोग भी आजाद हो जाएं और कही काम-धंधा करें। कानूनी कार्यवाही तो चलते ही रहेगी। अपनी पूरी बात कहने पर अच्छा लग रहा है, एक बोझ हमारे ऊपर से हट गया। हम बहुत खुश हैं कि सुप्रीम कोर्ट में मामला चला गया है। हम भूखे पेट यहां आये थे और उसे भी लग रहा था, लेकिन अब अपनी खुशी संभाले नहीं संभल रही है। आपके द्वारा कहानी सुनने पर लगा था कि यह हमारी कहानी है, बहुत अच्छा लग रहा था। ध्यान योग करके बहुत आनन्द आया। अब हम लोग कही भी आ-जा सकते हैं।

हिन्‍दु-मुस्लिम विवाद ने हमें अपाहिज बना दिया : अब्‍दुर रहमान

डॉ. लेनिन रघुवंशी पूर्वी उत्तरप्रदेश में ग़रीब और कमज़ोर लोगों के साथ होने वाले तरह-तरह के ज़ोर-जुल्‍म की कहानियां सरोकार को भेज रहे हैं. इस बार पेश है वाराणसी में हिन्‍दु-मुस्लिम समुदायों के बीच हुए विवाद में पुलिसिया गोली का‍ शिकार बने बुनकर अब्‍दुर रहमान की दास्‍तां उन्‍हीं की जुबानी :
मेरा नाम अब्‍दुर रहमान, उम्र 24 साल है। मैं एन 13/1202 लमही, सराय सूरजन, बजरडीहा, वाराणसी का निवासी हूँ। मेरे चार भाई, दो बहन हैं। पिता जी अलग रहते हैं, हमारी माँ की देहान्त हो जाने पर पिता जी ने दूसरी शादी कर ली थी। दूसरी माँ को दो बच्चे है।
मेरे साथ जो घटना घटी, वह दिन था 11 मार्च 2009, और समय था 11 बजकर 30 मिनट। मैं घर से अपने चाचा से मिलने के लिए निकला था। मेरे चाचा गौसिया मदरसा के बग़ल में रहते है। गौसिया मदरसा के पहले एक गली है। हम उस गली से जैसे ही दो क़दम आगे बढ़े, तभी पुलिस वालों ने फायरिंग शुरू कर दी। पुलिस की गोली हमारे दाहिने पैर और गुप्तांग के पास लगी। हम वहीं पर गिर गए। इसके बाद पुलिस वालों ने हमें घसीटते हुए अपने जीप में फेंक दिया और सरकारी अस्पताल, कबीर चौरा में भर्ती करा दिया। धीरे-धीरे हमारी आँखे बन्द होती जा रही थी। शरीर से बहुत ज्यादा खून निकल रहा था। कुछ समय बाद मैं बिल्कुल बेहोश हो गया। होश आया तो देखा, हमारे घर वाले और मोहल्ले वाले हमारे पास खड़े थे। उस समय हमें बहुत ही ज्यादा दर्द हो रहा था। हम जोर-जोर से चिल्ला रहे थे। हमने घर वालों से पूछा, ‘‘हमको क्या हुआ है?’’, हमारे घर के लोगों ने रोते हुए बताया, ‘‘तुम्हे पुलिस वालों ने गोली मारी है।’’ फिर हमने पूछा, ‘‘हमने क्या किया कि हमें गोली मारी?’’, तब मोहल्ले के लोगों ने बताया कि कोल्हुआ मस्जिद पर कुछ लोगों ने रंग फेंक दिया था, इसी बात पर हिन्दू और मुस्लिम समुदाय में विवाद हो गया और पुलिस वालों ने गोलियाँ चलानी शुरू दी जिसमें तुम्हें भी गोली लगी। अस्पताल में हम 13 दिन तक बेहोश पड़े रहे। उस समय हमारा इलाज चन्दे के पैसों से चल रहा था और आज भी चन्दे से ही चल रहा है। हम अपने समुदाय के लोगों का यह सहयोग कभी नहीं भूलेंगे। हिन्‍दु-मुस्लिम विवाद ने हमें अपाहिज बना दिया।
इस घटना से मेरी स्थिति ही बिगड़ गयी। इसके पहले हम बनारसी साड़ी की बुनाई का काम करते थे, लेकिन मेरा पैर गोली लगने से खराब हो गया। वैशाखी का सहारा लेकर चलना पड़ रहा है। पहले अपनी कमाई से घर में भी सहयोग करते थे और अपना खर्च भी चलाते थे। अब जिंदगी बहुत कठिन और भारी लग रही है। पहले की तरह दोस्तों के साथ घुमना-फिरना एक दम बंद हो गया। अब सभी से दूर हो गये हैं। यह सब देखकर बहुत गुस्सा आता है। दिमाग विचलित हो जाता है। एक बात का बहुत अफसोस है कि पहले कमाकर खाते थे आज एक समय के भोजन के लिए मोहताज है। शादी-ब्याह हो जाती, अब यह भी एक सपना हो गया है।
एक साल होने जा रहा है, लेकिन दर्द लगातार रहता है। जिससे हम बहुत परेशान हो जाते हैं। किसी तरह मोहल्ले के लोग मेरा भरण-पोषण कर रहे हैं। पुलिस का यह अत्याचार हम कभी नहीं भूल सकते। सरकार ने अभी तक दोषियों को सजा नहीं दी और न ही हमें किसी प्रकार का आर्थिक मदद ही मिला सरकार की तरफ से। हमारे साथ कुल आठ लोग घायल हुए थे। दो की तो मृत्यु हो गयी। जब-जब यह घटना मेरे दिमाग़ में आती है, हम विचलित हो जाते हैं। हम अपनी लड़ाई कानून के सहारे लड़ना चाहते हैं, क्योंकि कानून सबको न्याय देता है। हमारे लिए न्याय तभी सफल होगा, जब दोषियों को सजा मिलेगी।

आज हम अपाहिज की तरह जिंदगी जी रहे हैं। कई जगह इलाज भी करवाये। 4 फरवरी 2010, वृहस्पतिवार के दिन बी0एच0यू0 स्थित सर सुन्दर लाल अस्पताल गये। जहां डाँक्टर ने एक लाख रुपये इलाज के लिए कहा। हड्डी टूट गई है और खोखली भी हो गई है। इन्फेक्‍शन हमेशा रहता है, जिससे गोली का घाव नहीं भर पा रहा है। पाण्डेयपुर स्थित संस्था से सहयोग मिला, डॉ0 शकील (खजूरी) से इलाज करवा रहे हैं। जिससे अब थोड़ा चल-फिर रहे हैं और अपना काम जैसे – कपड़ा साफ करना, इत्यादि कर लेते हैं। लेकिन भोजन के लिए दूसरे पर आश्रित हैं। अपने घर से भोजन नहीं मिलता है। कभी-कभी कोई पड़ोसी या दोस्त भोजन करा देता है। बाकी दिन किसी से पैसा मांग कर बिस्कुट और पानी पीकर गुजारा कर रहे हैं।
जब बी0एच0यू0 में डॉक्टर साहब ने इलाज में एक लाख रुपये के खर्च की बात कही तो सुनकर बेचैनी और घबराहट महसूस होने लगी थी कि एक लाख रुपया कहाँ से आयेगा। इलाज नहीं होगा। हम इसी तरह कब तक रहेंगे। हम सोच रहे थे कि लोगों के सहयोग से कुछ पैसों का इन्तजाम हो जाए, हम ठीक हो जाएं तो फिर से काम-धंधा करके अच्छी जिंदगी जीयेगें। लेकिन अब जिन्दगी जीना दुश्‍वार लग रहा हैं। इलाज के लिए भी अकेले कहीं नहीं जा पाते। परिवार का कोई सदस्य मदद नहीं करता। किसी दोस्त या पड़ोसी के सहयोग से अस्पताल जाते हैं नही तो मजबूरन इलाज नहीं हो पाता।
आप लोग से इतना खुल कर अपने दर्द को बताया। इससे हमको बहुत राहत महसूस हो रही है। इसके पहले जो भी लोग मुझसे पुछते थे कि क्या हाल है अब्‍दुर रहमान? तब बहुत गुस्सा आ जाता था। आप लोगों ने मुझे 10 मिनट का ध्यान-योग करा कर मेरे थकावट और दर्द को और कम कर दिया। हम अब रोज यह योगा करेंगे। हम यह चाहते हैं कि इस कहानी को कोर्ट (कानून), अखबार, पत्रिका में प्रकाशित किया जाए। जिससे लोगों को पता चले कि किस तरह एक सीधा-साधा बुनकर अपाहिज हो गया। लोग जानें कि इसके पीछे कौन लोग हैं और फिर लोग उन्‍हें बददुआ दें।

पुलिस ने हमें पेशाब पिलाया : रामजी गुप्‍ता

डॉ. लेनिन रघुवंशी पूर्वी उत्तरप्रदेश में ग़रीब और कमज़ोर लोगों पर पुलिसिया उत्‍पीड़न की कहानियां सरोकार को भेज रहे हैं. पेश है उस श्रृंखला की तीसरी कड़ी. इस बार एक वाहन चालक रामजी गुप्‍ता और उनके परिवार के साथ हुए भयानक पुलिस उत्‍पीड़न की दास्‍तान उन्‍हीं की जुबानी :

मेरा नाम रामजी गुप्ता, उम्र-50 वर्ष है। पिता जी का नाम स्व. राम प्रसाद गुप्ता है और मैं सिपाह, मकान नं. 252, पोस्ट-सदर, थाना-कोतवाली, जिला-जौनपुर (उत्तर प्रदेश) का रहने वाला हूं। मेरे परिवार में आठ सदस्य हैं। मैं, मेरी पत्नी गायत्री देवी (46 वर्ष), चार बेटे विनोद कुमार (28 वर्ष), मनीष कुमार (26 वर्ष), चंदन कुमार (24 वर्ष), आशीष (21 वर्ष), बहू सीमा देवी (25 वर्ष) और एक पोता आदित्य कुमार (2 वर्ष) है।

मैं पेशे से ड्राइवर हूं, लेकिन अब शुगर की बीमारी के कारण कभी-कभी ही ड्राइवरी का कार्य करता हूं। मेरा बड़ा लड़का विनोद भी गाड़ी चलाता है। वह जौनपुर के ख्वाजा दोस्त के रहने वाले महेन्द्र सेठ का सेंट्रो कार चलाता था। 23 जनवरी को रात्रि 12.30 बजे पिण्डरा बाजार से लगभग 1 कि.मी. आगे एक गाड़ी ने ओवरटेक करके उसकी गाड़ी को रोका और चार बदमाश असलहा से लैस उतरे और सेठ के लड़के अजय सेठ व मेरे बेटे के साथ मार-पीट किये और लूट-पाट किये। मेरे लड़के को अपने साथ जबरन उठा भी ले गये। इस बात की सूचना मेरे मोबाइल नं0-9792731268 पर सुबह लगभग 4 बजे महेन्द्र सेठ के फोन के द्वारा मिला. यह सुनकर मैं डर गया और मन में डरावने विचार आने लगे कि कहीं मेरे बेटे को बदमाश मार कर फेंक न दें! इसी आशं से मैंने सेठ जी को फोन किया और अजय सेठ के बारे में पूछा कि, ‘‘वो कहां हैं?’’ सेठ जी ने कहा, ‘हम लोग थाने पर हैं और तुम्हारे बेटे की तलाश की जा रही है, अगर वह घर पहुंचे तो मुझे सूचना देना।‘ यह सुनकर पूरा परिवार चिंतित हो गया. बहू और मेरी पत्नी लगातार रो रही थी, जिसे देखकर मेरा पोता भी जोर-जोर से रोने लगा।

किसी तरह हम लोग सुबह होने का इंतजार करने लगे। इसी बीच करीब 5:30 बजे सुबह कोई दरवाजा खटखटाया। मेरा दूसरा लड़का जाकर पूछा और दरवाजा खोला. विनोद बाहर खड़ा था। वह जैसे ही घर पहुंचा, कुछ ही देर बाद फुलपुर थाना की पुलिस आ धमकी और यह कहकर उसे ले गयी कि पूछताछ करनी है। उसी दिन से उसे तरह-तरह की यातना दी गयी। उसकी दशा देखकर पूरा परिवार विक्षिप्त-सा हो गया है। पुलिस द्वारा उठा ले जाने के बाद मैं दौड़े-दौड़े थाने गया. वहां विनोद दिखाई नही दिया था. हमने पुलिस वालों से पूछा भी, लेकिन उन लोगों ने डांटकर भगा दिया। यह सब देख- सोच कर दिमाग़ पागल-सा हो रहा था कि आखिर मेरे बेटे को वे लोग कहां ले गये. कहीं मार तो नहीं देंगे, किसी मुकदमे में फंसाकर पूरी जिंदगी बर्बाद न कर दें!

फिर मैंने राष्ट्रीय मानवाधिकार आयोग, नई दिल्ली को फैक्स किया, स्थानीय पुलिस अधिकारियों को तार, इत्यादि भी किया. कई बार मैं थाने पर गया, लेकिन मुझे मेरे लड़के से मिलने नहीं दिया गया। मुझे हर बार वे डांटकर थाने से बाहर भगा देते थे। इसी तरह दौड़-धूप करते-करते मेरा शरीर थक-हार कर टूट गया। दिनांक 29 जनवरी, 2010 को शाम करीब 4 बजे फूलपुर (वाराणसी) एस.एच.ओ. का फोन आया, उन्होंने कहा ‘‘आकर अपने लड़के को ले जाओ।’’ वहां हम दोनों से हस्ताक्षर करवाया गया। उन्होंने किसी उच्चाधिकारी से बात की और बोला, ‘अभी दो दिन विनोद को और रखेंगे, तीन मुजरिम पकड़े गये हैं, उनकी शिनाख्त करवानी है।‘ लेकिन किसी भी मुजरिम का शिनाख्त नहीं करवायी गयी। इस बीच उसे कठोर यातना दी गयी. और 1 फरवरी को नौ दिन बाद छोड़ा गया. पुलिस वाले बोले, ‘‘बुलाने पर आना होगा।’’

जब मेरे लड़के को मेरे हवाले किया तो उसकी हालत देखकर मैं रो पड़ा। घर लाकर इलाज शुरू करवाया. उसे कुछ राहत मिली और हमें थोड़ी शांति महसूस हुई। इसके बाद फिर 12 फरवरी की रात 12 बजे एस.ओ.जी. की पुलिस हमारे घर आयी और जोर-जोर से दरवाजा पीटना शुरू किया। मेरा छोटा लड़का (मनीष) दरवाजे के पास जाकर पूछा कि कौन है। उन लोगो ने गाली देते हुए कहा, ‘‘खोल दरवाजा, हम पुलिस वाले हैं।’’ पूरा परिवार जग गया। हम सोचने लगे कि फिर से कुछ न कुछ करेंगे। मनीष ने दरवाजा खोला, करीब आधा दर्जन लोग घुस कर मारना-पीटना करने लगे। मेरी पत्नी बेहोश होकर गिर गयी। उस समय मुझे लगा कि मेरा हार्ट फेल हो जायेगा। मेरी पत्नी जब होश में आयी, तब उसको पुलिस वालों ने बूट से मारा और उसकी इज्जत पर हाथ डालना चाहा. लेकिन कुछ पुलिस वालों ने ऐसा करने से उन्हें मना किया। लेकिन वे लगातार मुंह से अश्लील बातें बक रहे थे। मेरी बहू को रखैल बनाकर नंगा नचवाने की बात तक कही. यह सब देख-सुन कर मुझे बहुत क्रोध आ रहा था कि इन सबके साथ क्या कर बैठूं. लेकिन मजबूर था. मेरे हाथ बार-बार कांप रहे थे, लग रहा कि हाथ छोड़ दें. लेकिन विवश होकर केवल हम गिड़गिड़ा रहे थे। घर का सारा सामान तितर-बितर कर दिया और पूरे परिवार सहित उठा ले गये। सिपाह पुलिस चैकी पर ले जाकर दुबारा सभी को मारना-पीटना शुरू कर दिया। जब ये लोग अपने साथ ले जा रहे थे, उस समय लगा कि पैंट में ही शौच हो जायेगा। मैं डरते-डरते उन लोगो से बोला भी. लेकिन उन्होंने कहा, ‘‘चल साले, मैं तुझे कराता हूं।’’ सिपाह पुलिस चैकी पर हाथ-डंडा से मारना शुरू किया. औरतों को जूता से मारा व साड़ी तक खींचा. उसके बाद तीनो मोबाइलें जब्त कर ली, जिनका नं0 9792731261 (मेरा), 9305754951 (मनीष) तथा 9336280429 (चंदन) है।

मेरी पत्नी एवं तीन मासूम बच्चों को थाना कोतवाली (जौनपुर) में एक रात और एक दिन रखा. दूसरे दिन पत्नी को छोड़ दिया. लेकिन मेरे तीन मासूम बच्चों को मारते-पीटते पुलिस फूलपुर थाने ले गयी. जहां हमें और विनोद को लेकर आये थे। वहां बच्चों को दो दिन रखा गया, और जब इन दोनों का स्वास्थ्य बुरी तरह खराब होने लगा, तब छोड़ दिया गया। फिर मुझे व विनोद को अलग-अलग थाने में रखा गया था। हमें दो दिन चोलापुर में अकेले रखा गया। वहां हम विनोद के बारे में सोच रहे थे कि उसके साथ लोग क्या करे होंगे? हमें अलग क्यों रखा गया? यह सब सोचकर बेचैनी हो रही थी। दो दिन बाद विनोद और हमें सिंधौरा पुलिस चैकी तथा दो दिन फूलपुर थाने में रखा गया।

इतने दिनों में मेरी शारीरिक पीड़ा इतनी ज्यादा बढ़ गयी थी कि मन में आया आत्महत्या कर लूं, लेकिन यह सोचकर रुक गया कि मेरे बाद मेरे परिवार का क्या होगा? मेरे और मेरे परिवार के साथ जो अश्लील हरकतें पुलिस वालों ने की तथा जो यातना दीं, वह असहनीय रहा। दिनांक 13 फरवरी को पुलिस लाइन (वाराणसी) में मारा-पीटा गया. यहां तक कि जबरदस्ती मेरे मुंह में पेशाब पिलाया गया और मेरे लड़के विनोद को भी पेशाब पिलाया गया तथा कान में पेट्रोल डाला गया। जिसकी घृणास्पद पीड़ा बर्दाश्त नहीं हो पा रही थी।

अभी भी सोचकर घृणा से मन उल्टी जैसा होने लगता है, रोगटें खड़े हो जाते हैं। उसको याद करना नहीं चाहते हैं। यह सब सोचकर पागल हो जाता हूं कि जब इस बारे में लोग जानेंगे, तब लोग क्या सोचेंगे! 18 फरवरी तक वे लोग इधर-उधर नचाते रहे और इसी दिन रात में 8 बजे छोड़ा तथा कहा कि बाहर जाकर कोई कदम मत उठाना, नहीं तो किसी और मुकदमे में फंसा देंगे। वहां पर मैंने उनके हां में हां मिलाया, ‘‘मैं कुछ भी नही करूंगा सर।’’ लेकिन मुझे अपनी लड़ाई लड़नी है। मैने बाहर आकर अपनी लड़ाई लड़नी शुरू कर दी। मुझे न्याय व सुरक्षा चाहिए। परिवार सही सलामत रहे। मेरी रोजी-रोटी में कोई रुकावट पैदा न हो। इसके लिए मैं सरकार से गुहार लगाना चाहता हूं। छोड़ने के तीन-चार दिन बाद एस.ओ. फूलपुर का मेरे मोबाइल पर 11:30 बजे दिन में फोन आया. बोले, ‘‘विनोद को लेकर बाबतपुर चैराहे पर आ जाओ।’’ जब हम फोन पर एस.ओ. साहब से बात कर रहे थे तब घर की महिलाएं बेचैन होकर रोने लगीं और बोली, ‘‘फिर क्या हो गया, कहीं दुबारा बंद न कर दे!’’ हम दोनों लगभग साढे चार बजे बाबतपुर पहुंचे. उन्होंने हमें जीप में बैठने को बोला और दोनो को लंका थाना (वाराणसी) लेकर आये। वहां पर सी.ओ. और एस.ओ.जी. वाले विनोद को गाली देते हुए कड़ी पूछताछ करने लगे। यह देखकर मैं घबरा गया कि कहीं फिर अंदर करके मारना-पीटना शुरू न कर दें। शरीर में सिहरन हो रही थी। अभी भी याद करके रोंगटे खड़े हो जाते हैं।

पूछताछ के बाद लंका से फूलपुर थाने लाये और ट्रक पकड़ा दिया। छोड़ने से पहले बोला, ‘तुम दोनों घर छोड़कर कहीं मत जाना।‘ हमलोग कहीं कुछ कर नहीं रहे हैं. घर पर ही पड़े रहते हैं, जिससे रोजी-रोटी पर मुसीबत आ पड़ी है। जब हमलोग घर पहुंचे तब परिवार वालो में खुशी की लहर दौड़ गई और उन्‍होंने भगवान को शुक्रिया किया।

सबसे ज्यादा आंतरिक पीड़ा 24 जनवरी को हुई, जब सेठ एफ.आई.आर. कराकर बिना कुछ कहे मेरे बेटे को थाना में छोड़कर चले गये और 12 फरवरी को औरतों व बच्चों के साथ मार-पीट किया गया। उसके बाद 13 फरवरी को मुझे पेशाब पिलाया गया, वह घटना सर्वाधिक तनाव उत्पन्न करती है। जीवन से घृणा-सी होने लगी है। आज भी नींद आधी रात के बाद आती है, अगर बीच में टूट गयी को तो फिर दुबारा नहीं आती. सारी रात एकटक छत को घूरता रहता हूं। दिमाग़ में वही सब बातें आने लगती हैं. नींद नहीं आती। चिंता व डर अभी भी रहता है कि रात में फिर से कहीं कोई न आ जाये और उठा ले जाये।

दूसरी तरफ सेठ जी लोग धमकाते हैं, यहां तक कि एस.पी. के सामने डाक बंग्ला में जान से मारने की धमकी व उठा लेने की बात कहते हैं। जिससे डरता हूं कि कुछ अनहोनी न हो जाए। हमारे विचार में यह है कि मुझे जिस प्रकार से प्रताड़ित किया गया है, उसके एवज़ में मुआवजा मिले और मान-सम्मान पहले की तरह बनी रहे। सच्चाई सभी के सामने आये और दोषियों पर न्यायोचित कार्यवाही हो। मैं खुद चाहता हूं कि मामले की न्यायिक जांच सीबीसीआईडी एवं सीबीआई से करायी जाए।

आपके द्वारा कहानी सुनाते हुए पल-पल की याद आ रही थी और वही बेचैनी व घबराहट हो रही थी। लेकिन ध्यान-योग करने के बाद शरीर में हल्कापन और दिमाग़ में तनाव कम हुआ है। सब कुछ ताजा-ताजा नजर आ रहा है. लग रहा है कि अभी नींद से जागे हैं, सुबह जैसा लग रहा है. इस दस मिनट के योग से बहुत परिवर्तन महसूस कर रहा हूं मन शांत है। मुझे परिवार पर हुए अत्याचार के खिलाफ लड़ाई लड़नी है. मुझे न्याय मिले।

Two Amnesty International representatives have been detained by police in Cairo after the Hisham Mubarak Law Centre was taken over by military police this morning.

The Amnesty International staff members were taken, along with Ahmed Seif Al Islam, Khaled Ali, a delegate from Human Rights Watch and others, to an unknown location in Cairo. Amnesty International does not know their current whereabouts.

“We call for the immediate and safe release of our colleagues and others with them who should be able to monitor the human rights situation in Egypt at this crucial time without fear of harassment or detention,” said Salil Shetty, Secretary General of Amnesty International.

As mass anti-government protests flare across several countries in the Middle East and North Africa, Amnesty International is urging all state authorities in the region to respect human rights, including the rights of those now demanding change.

Repressive governments across the Middle East and North Africa are under pressure and face surging demands for political, economic and social reform. Already, protesters have been killed on the streets by police and thousands have been arrested or beaten as state security forces try to quell the unrest. मेरा नाम रघूलाल, उम्र-23 वर्ष, पुत्र-श्री बिंदा बिंद। मैं गाँव-सागर सेमर, पोस्ट-हिनौती, थाना-पड़री, जिला-मिर्जापुर (उत्तर प्रदेश) का निवासी हूँ। मैं पत्थर तोड़ने का काम करता हूँ, महीना में 10-15 दिन काम मिलता है। हमारे परिवार में चार सदस्य हैं-मैं और मेरी पत्नी उर्मिला, दो लड़का-लवकुश (3 वर्ष) व आशीष (1 वर्ष)।

हमारे साथ जिंदगी में यह पहली घटना घटी जिससे मैं शारीरिक व मानसिक रूप से क्षमता विहीन हो गया। उस घटना के कारण घर से बाहर निकलने में डर लगता है। अब काम-काज करने का हिम्मत ही नही करता। हमेशा चिन्ता व डर बनी रहती है कि दुबारा फिर से हमारे साथ अमानवीय व्यवहार व मार-पीट न किया जाए। इसलिए किसी से बातचीत करने में भी डर लगता है।

पुरवा हवा चलने पर पूरे शारीर में दर्द उठने लगता है, अब परिवार का भरण-पोषण करना मुश्किल हो गया है। रात में जब नींद टूट जाती है तो फिर नींद ही नही आती. सारी रात यह सोचते-सोचते कट जाती है कि जो मेरे साथ हुआ उससे अच्छा मर जाना ही उचित था।

हुआ यह कि मैं 28 मई, 2009 को अपने ससुराल साले जी की शादी में ग्राम-बहरामागंज, पोस्ट व थाना-चुनार, जिला-मिर्जापुर (उत्तर प्रदेश) गया था। 29 मई को लगभग 10 बजे रात में हम बाजार से ससुराल (घर) चलने वाले थे कि चुनार थाना के जीप पर सवार वहाँ के दरोगा व सिपाही आये, हमें उठाकर गाड़ी में बिठा लिया। अचानक इस हरकत से मैं घबरा गया। रात का समय था, डर के मारे मैं उनसे कुछ पूछ भी नही सका। चोरी हुई जगह और मेरे घर घुमाते-फिराते थाना में लगभग 2.00 बजे रात में पहुँचे। उस समय 2 बल्ब दरोगा के कमरे में तथा तीन बाहर में जल रहे थे। हवालात में बल्ब नहीं था। हमें उसी हवालात में बंद कर दिया गया। कुछ समय बाद दो रोटी और सब्जी हमें भोजन के लिये दिया गया। अभी भोजन किये ही थे कि हमें फिर दो सिपाही हथकड़ी लगाकर बाहर लाये और जीप में बिठा दिया, यहाँ से वे लोग हमें सुदर्शन दरोगा के आराम करने वाले कमरे पर ले आये. वहाँ पर पहले से ही थाना से सम्बन्धित दो लोग उपस्थित थे। यहाँ से जीप में बिठाकर वे पाँचों लोग हमें डगमगपुर स्थित एक फैक्ट्री के पास ले गये और हमें डराते व धमकाते हुये पूछा कि बताओं तुम्हारे साथ कौन-कौन लोग थे। वह एक सुनसान क्षेत्र है. रात में पूरा सुन-सपाटा छाया हुआ था। डर के मारे पुरा शरीर पसीना से लथपथ हो गया था. डर लग रहा था कि कही मारकर फेंक न दे। आज भी वह दिन याद करके रोंगटे खड़े हो जाते हैं। डराने व धमकाने के लगभग आधे घंटे बाद चुनार चौकी के समीप ही बिहारी ढ़ाबा है, वहाँ ले आये. अपने लिये वे लोग चाय मंगवाये और हमें कांच की गिलास में दारू पीने के लिये दिया। हमने कभी शराब नहीं पी थी. जब हमने शराब पीने के लिये मना कर दिया, तब गाली देते हुए सिपाही आया व मारने लगा और दूसरा सिपाही जबरदस्ती मुँह में लगाकर हमें दो गिलास शराब पिला दिया। उस समय हम मर जाना उचित समझते थे और यह ठीक भी रहता। शराब पिलाने के बाद उसी समय और लोगों के घर छापा मारा गया तथा 12 लोगों को पकड़ा। उसमें से कई लोग हमारे गांव व इलाके के रहने वाले थे।

30 मई, 09 को दिन में लगभग 12 बजे दरोगा हमें अपने दफ्तर में बुलाया तथा हमारे साथ मार-पीट करने लगा, हमारी दायां हथेली पर कुर्सी रखकर उस पर बैठ गया तथा बोला कि बताओ डकैती का समान कहाँ है, कौन-कौन से लोग इसमें शामिल हैं। हम बेकसुर थे. हम कुछ नही जानते थे. इसलिए हमने कुछ नहीं बोला., तब दरोगा ने सिपाहियों को बुलाया, सिपाही हमें कमरा के बाहर लाये तथा कम्पाउड में डंडे से पिटाई करने लगे तथा चोरी का हामी भरा रहे थे। सर छोड़कर पूरे शरीर पर आगे-पीछे, बेरहम की तरह पिटाई करने लगे. जिससे दांये हाथ के अंगूठा में जबरदस्त चोट आई, जो आज तक सूजा हुआ है। कुर्सी से कुचलने के कारण हथेली के ऊपरी हिस्से पर निशान अभी भी है तथा सूजा हुआ है। उस समय तो हम डर गये थे कि हथेली का हड्डी टूट गया है, लेकिन एक्स-रे करवाने पर पता चला कि हड्डी नहीं टूटी है, तब जाकर थोड़ा राहत महसूस हुआ। मार-पीट के बाद वे लोग हमें हवालात में डाल दिये। दिन भर हमें खाना भी नही दिया. शाम को 4 बजे घर से खाना आया तब खाना खाये। उसी दिन लगभग डेढ बजे रात में फिर सुदर्शन दरोगा अपने निवास पर बुलाया. कहा कि झूठ या सच कुछ तो बताओ? वहाँ पर हमें लगभग डेढ घंटे रखा. उसके बाद सिपाही को बुलाया तथा हमें थाना ले जाने को बोला। वहीं पर सिपाही ने हमें दो डंडे मारे तथा जीप में बिठाया. जीप में हमें मारते हुए थाने ले आया। हवालात के सामने लगातार डंडे की बारिश हमारे ऊपर करने लगे. जब हम गिर गये तब हवालात में 15 कैदियों के साथ बंद कर दिया। रात में खाना भी नहीं दिया।

अगले दिन फिर दरोगा अपने कार्यालय में बुलाया तथा थाना परिसर में रखी पत्थर पर बैठने को बोला, जो चारो-ओर से बिजली के तार से घिरा हुआ था. बैठने के बाद हमें दो बार बिजली का करेंट लगाया और करेंट देने लगा। उसी समय मेरा भाई ओम प्रकाश समोसा लेकर आया था. होमगार्ड ने उसे समोसा देने से मना किया तथा बोला कि इसके लिए चना और लाई लेते आओं। जब भाई खाने का समान दे रहा था, उस समय हम केवल इतना बोले कि हमें पानी-पिला दो, अब जिंदगी का कोई पता नही। उसने हमें पानी पिलाया। इसके बाद हमें तीसरी बार करेंट दिया, जिसके कारण हम बेहोश हो गये।

पाँच दिन बाद जब हमें होश आया, अपने को मैं सरकारी जिला अस्पताल मिर्जापुर में लेटा पाया. यह देखकर हम अचम्भित हो गये। हाथ के इशारा से मैंने अपने जीजा जी से पूछा, तब वे बोले कि आपकी हालत खराब हो गई थी, इसलिए आपको भर्ती किया गया है। दो दिन तक हमें कुछ याद नहीं रहा। बाद में धीरे-धीरे पता चला कि हमारे साथ पुलिस वाले क्या-क्या किये हैं।

सप्ताह भर हम अस्पताल में रहे, उसके बाद घर आये। पुलिस वाला हमें पूछने तक नहीं आये। बाद में हमें पता चला कि लोगों ने चुनार व डगमकपुर के चौराहे पर चक्का जाम किया था. पडरी थाना के दरोगा जी व क्षेत्रीय विधायक भी हमसे अस्पताल में मिलने आये थे। अखबार वाले भी आये थे, जिन्होंने हमारी हालात व चुनार दरोगा के मनबढ़ी व अत्याचार पर खबर अखबार में छापे थे। बंदी के दौरान चुनार के दरोगा सुदर्शन हमारे ससुर श्री लक्ष्मण व भाई (जीतू) से 13,000 रुपये हमें छोड़ने के एवज् में लिया था।

मिर्जापुर अस्पताल में भर्ती होने के पहले हमें चुनार क्लिनिक में भर्ती करवाया गया था, जहाँ डाक्टरों ने हमारी स्थिति नाजूक देखते हुए मिर्जापुर जिला अस्पताल भेजने को बोला था। तब क्षेत्रीय विधायक जी के कहने पर एम्बुलेंस से मिर्जापुर अस्पताल लाया गया था. वहां हमारा सर व हाथ का एक्स-रे भी हुआ था।

बायीं तरफ पीछे की हिस्सो में दर्द अभी भी है। हमारे घर से पुलिस जो समान उठाकर ले गई थी, वह मिल गया है, लेकिन जो समान पटेल परिवार ले गये जैसे-हसुली पायल, बल्ला: नहीं मिला है।

मारपीट का याद आने पर मर-जाना उचित लगता है। अभी जब हम आपके कार्यालय आ रहे थे, तो बगल वाली जो मंदिर है वहाँ पुलिस को देखकर अंदर से सहम गये थे, मेरा मुँह सुखने लगा था।

जब से अस्पताल से आये हैं, घर छोड़कर कहीं नहीं जाते, एक-दो बार केवल दवा-ईलाज हेतु बाबू जी के साथ ही गये हैं। अपनी कहानी कहने व सुनाने के बाद डर पैदा होता है। दोषी पुलिसकर्मियों पर कार्यवाही हो. जिससे वह भी सीख लें कि नाजायज व गैर कानूनी तरीकों से आम आदमी के साथ इस तरह से अमानवीय ढ़ंग से मार-पीट व गाली गलौज न करें। पटेल परिवार जो हमें डकैती में फँसाया है, उसे भी दण्ड मिले।

आपको कहानी सुनाकर व यहां आकर धीरे-धीरे अब डर कम होने लगा है। गाँव व क्षेत्र में मेरी कहानी पढ़ी जाए। मार-पीट के कारण जो इज्जत गयी है, वह लौट तो नहीं सकती, लेकिन सभी हमारी कहानी को जाने कि पुलिस कैसे बेगुनाह के साथ अमानवीय व्यवहार करती है। दुनिया जाने की पुलिस का असली चेहरा क्या है तथा अखबार एवं समाचार में मेरा कहानी पढ़ा एवं प्रसारण किया जाय। अभी जब आपने हमारी कहानी पढ़कर सुनायी, हमें बहुत अच्छा लगा तथा अब पहले से बेहतर व अच्छा महसूस कर रहा हूँ.

मेरा नाम रीना (बदला हुआ नाम), पत्नी श्री विनोद कुमार गुप्ता, मकान नं0-137, मोहल्ला-सिपाह, थाना-कोतवाली, जौनपुर की निवासनी हूँ। मेरे पति शादी के पहले से ही ड्राइवरी का काम करते हैं। 24 जनवरी को लगभग 4.30 से 5.00 बजे भोर में पुलिस आयी और मेरे पति विनोद को ले गयी। उस वक्त में अपने बेटे को गोद में ली थी और वो अपने पापा को बुला रहा था। उस समय मुझे लगा कि हमारे ऊपर मुसीबतों का पहाड़ टूट पड़ा है, मुझे कोई रास्ता नही सुझ रहा था कि क्या करें। मैं रोने-पीटने लगी। मैने यह सोचा कि पुलिस घटना की पुछ-ताछ करके छोड़ देगी। लेकिन पति के वापस न आने के बाद मेरा और मेरी अम्मा (सास) की हालत खराब हो गयी। मेरे अम्मा जी तो बार-बार बेहोश हो जा रही थी। दोपहर में आस-पड़ोस के लोग इकठ्ठा हुए और सात्वना दी और कह कि इतना सीधा लड़का कहा फँस गया और उन लोगो ने सलाह दी कि सेठ जी से बात करने पर शायद सब ठीक हो जाये। मेरी अम्मा इसी आस में सेठ जी के घर जाकर उनके हाथ जोडे़ और पैर भी छुए, सेठ ने कहा कि अब आप लोग राम-राम करें।

वापस फिर 12 फरवरी, 2010 को 10 बजे रात सेठ SOG को लेकर हमारे घर पर आये और घर में रखे तीन मोबाइल को अपने कब्जे में ले लिया। पुलिस ने हमारे कमरे के पूरे समान को चेक किया। मैने एक छोटे से पर्स में पायल और लगभग 3000 से 4000 रुपये बचाकर रखे थे। उनके जाने के बाद सुबह मैने पर्स देखा तो पर्स में सिर्फ पायल मिला और मेरे पापा ससुर और पति को ले गये।

10 मिनट बाद दोबारा फिर आये ‘‘यह बात बताने में कांप जा रही हूँ। उस समय मैं घर में बिल्कुल अकेली थी। मेरी अम्मा और देवर, बड़े पापा (मेरे ससुर के भाई) को घटना की जानकारी और बुलाने गयी थी। उस समय मुझे अकेला देखकर एक पुलिस वाला मेरे साथ बदतमीजी करने लगा और मुझे गन्दी-गन्दी गाली देने लगा। जब वह मेरा पास आया तो उसके मुँह से शराब की बदबू आ रही थी।

मार के डर से मेरे पति ने कहा कि उसने रिवॉल्वर घर में एक अमरूद के पेड़ के नीचे छिपाया है। वापस पुलिस मेरे पति को लेकर रिवाल्वर खोजने के लिए खुदाई शुरू की। उसी बीच फिर वही खड़ा एक पुलिस वाला मेरे पास आकर फिर से बदतमीजी करने लगा और मेरी अम्मा से बार-बार कहने लगा कि तुम्हे टॉयलेट जाना है तो जाओ। वह मेरी सास को बहुत गाली दिये और लगातार जूते की नोंक से चार-पाँच बार मारे। मुझे गाली देकर कहा कि ‘‘तुम्हे यही मिला था शादी करने के लिए’’ और मेरी अम्मा से पुछा कि कहां से लायी है इसे। सरायमीर का नाम सुनते कि उसने मेरी इज्जत को तार-तार करते हुए कहा कि इसके ऊपर न जाने कितने मुसलमान चढ़े होगे।

इसके बाद उन लोगो ने मेरी अम्मा को भी अपमानित किया ‘इतना बदमाश लड़का पैदा करने के लिए तु तो चार-पाँच लोगो के पास तो गयी होगी। यह भी कहा कि तुम्हारे गुप्तांग में ऐसा मारेगे कि तुम्हारी बच्चेदानी बाहर आ जायेगी। इतना कहते हुए उन लोगो ने हमारी साड़ी खीचने की कोशिश की। प्रतिरोध करने पर उन लोगों ने हमारी अम्मा को वापस जूते की नोंक से मारा और धमकी दी कि तुम्हारे खानदान में किसी को नही छोड़ूंगा। सबको बेइज्जत करूँगा।
मेरे पति के सामने कहा कि तुम्हारी बीवी को यही तुम्हारे सामने सुलाकर शारीरिक सम्बन्ध बनाऊँगा। उस समय मुझे लगा कि अपनी इज्जत बचाने के लिए कहा भागे, कोई रास्ता सुझ नही रहा था। इस बात को याद कर अभी भी डर लगता है और खुद से शार्म महसूस होती हैं। उन लोगों ने मेरे पति को बच्चे की कसम दिलायी कि मेरे घर में कुछ नहीं है और फिर मेरे पति को कमरे में ले जाकर बेड पर सुलाकर सीने पर बहुत मारा, मार की आवाज बाहर तक आ रही थी। वे लोग मेरी अम्मा और देवर को ले जा रहे थे, मुझे भी चलने को कहॉ, मैने कहा कि मेरा बच्चा सो रहा है तो उन लोगो में मुझे छोड़ दिया।

मेरा एक बच्चा तीन साल का है और दूसरा अभी गर्भ में है। अभी यही चिन्ता रहती है गुजारा कैसे होगा, 18 फरवरी को पुलिस ने मेरे पति को छोड़ दिया। हम लोग को यह डर है कि सेठ फिर से हमारे घर न आये और दोबारा इस तरह से गाली-गलौज और मार न सहना पड़े। अभी खाने पीने में बिल्कुल मन नही करता है। अभी घर में कोई काम काम करने वाला नही है। इस घटना के बाद देवर और ससूर का काम भी छुट गया है।

डर के कारण मेरे परिवार के सभी सदस्य एक ही जगह सोते हैं। मेरे पति इतने डरे हुए हैं कि टायलेट भी अकेले नहीं जाते हैं। मेरे पति और अम्मा को रात में नींद नहीं आती है, आती भी है तो नींद में ही अम्माँ-अम्माँ चिल्लाने लगते है। पुलिस मेरे पति को लेकर मेरे बहन के घर आजमगढ़ गयी और मेरे पति से बोला कि तुम भागो, तुम्हारा इनकाउन्टर कर देगे।

पुलिस इनको लेकर मेरे मामा, भाभी और सभी रिश्‍तेदारों के यहां लेकर गयी और उन्हें धमकाया भी। अभी यह लगता है कि न्याय मिल जाये और वापस हम लोग खुशी से अपना जीवन व्यतीत कर सकें। इस घटना के बारे में बताकर अन्दर से काफी हल्का महसूस कर रहे हैं। अपनी व्यथा आप लोगों से बांट कर थोड़ा अच्छा लग रहा है।

उत्तर प्रदेश के वाराणसी जनपद में बड़ागाँव ब्लॉक के मुसहर परिवारों की कहानी, समाज को उच्च शिखर पर पहुँचा रहा है, क्या आपको लगता है? आइये ज़रा महसूसने की कोशिश करें …

बड़ागाँव नाम से ही लगता है कि कितना विकसित होगा और कितना सुशोभित होगा यहाँ के नागरिकों का जीवन। मगर ये वास्तविकता से परे है। आज भी मुसहरों की स्थिति दयनीय है और उपेक्षाओं की मार से धरती पर कीड़े-मकोड़ों की तरह जीवन-जीने को मजबूर हैं। ऐसा लगता है कि जुल्मों-सितम को सहते हुए इसे नियति समझ बैठे हों। दिन की शुरुआत होती है, लेकिन यह पता नही रहता कि शाम तक बच्चों के लिए दो जुन की रोटी का जुगाड़ हो पायेगा कि नही। उस स्थिति में बच्चों के लिए शिक्षा तो दूर एक वक्त का भोजन मिल जाए यही सौभाग्य मानते हैं। प्राथमिक विद्यालय व आँगनबाड़ी की स्थिति आज भी मनुवादी सोच को चरितार्थ कर रही है।

एक तरफ राज दावा कर रही है कि जल्द ही हमारे प्रदेश में गाँव-गाँव तक चिकित्सा वाहन की सुविधा हर एक दलित बस्ती में पहुँचेगी, मगर वास्तविकता क्या है? अस्पताल के बाहर गर्भवती महिला तड़पते हुए अपने बच्चों को खो दे रही है, पीड़ा को दूर किये बिना उसके साथ छूआछूत का बर्ताव किया जा रहा है। क्या उनका इस जाति में जन्म लेना दुर्भाग्य है कि वो मुसहर जाति में पैदा हुई है। अगर कभी-कभार ए0एन0एम0 (सरकारी स्वास्थ्य सेविका) डिलिवेरी करवा देती है तो उस महिला के साथ पशुओं से भी ज्यादा अभद्र व्यवहार होता है और महिनों की कमाई की जमा पूँजी उल्टे ऐंठ ली जाती है।
ग़रीबी व भूखमरी मानों सदियों से इनको दरिद्रतापूर्ण जीवन जीने के लिये बेबस कर दिया हो। उत्तर प्रदेश कुपोषण और भूखमरी के शिकार बच्चों की स्थिति में अव्वल है जिसमें मुसहर जाति के बच्चे ज्यादा पाये गये है।

यातना और संगठित हिंसा का शिकार यह जाति किसी भी समय उच्च जातियों और पुलिस द्वारा उत्पीड़ित होते है, इनके लिए न्याय पाना तो दूर ये गुहार भी नहीं कर सकते, ऐसी यहाँ सामाजिक और प्रशासनिक व्यवस्था कायम है।

पुलिस द्वारा मुसहरों से घृणित कार्य करवाना मानों अब आदत सा बन गया है कि रात्रि-अर्द्धरात्रि, जब चाहे घर में घुसकर उठा लें और सड़ी गली लावारिश लाश फेंकवाना, थाने और जेल में आज भी शौचालय साफ करवाना व गंदी-गंदी वस्तुओं को जबरन उठावाना इत्यादि शामिल है।

उच्च जातियों द्वारा अपने यहां बेगारी करवाकर मजुदूरी न देना और समुदाय के महिलाओं के साथ छेड़छाड़ व असामाजिक दुर्व्‍यवहार आम बात है। अगर कभी इस समुदाय के लोग साफ़ कपड़े पहनकर रिश्‍तेदारी के लिये भी घर से निकलें और इन पर दबंग जातियों का नजर पड़ जाए तब जान-बूझकर जबरन काम करवाया जाता है ताकि इनके कपड़े मैले हो जाएं। लेकिन चुनाव की गर्माहट है तो मुसहर देवता, नहीं तो धोबी का कुत्ता बना रहता है। यही इनकी नियति है।

धर्म व जाति को प्रधानता देना लोगों द्वारा ढकोसला व मूर्खतापूर्ण असामन्जस्य फैलाने वाली समस्या अपने देश के लिए बतायी जा रही है। मगर वास्तव में ये एक व्यवसाय सा प्रतीत होता है जिससे कभी दबंगों, कभी पुलिवालों और कभी वकीलों का ही जेब भरता नजर आ रहा है।

हमारे देश में सदियों से चला आ रहा है कि स्त्री पूज्‍य है उसकी पूजा-अर्चना करनी चाहिये। कुछ समय पहले ही इस वक्तव्य को धूमिल होते देख हमारे संविधानदाता अनेक कानून व धारायें बनाकर चले गये। आज भी प्रत्येक शासनकाल में स्त्रियों की स्थिति में सुधार हेतु कुछ न कुछ योजनायें व आरक्षण की सुविधा महिलाओं को दी जा रही हैं। लेकिन क्या वो क्रियान्वित हो रहा है? या फिर केवल भाषणबाज़ी की संस्कृति बनकर रह जा रहा है। इसको भी हम यहाँ इस विशालकाय गाँव में अवलोकित होते हुए देख सकते हैं। पुरुष-महिला को अपनी जागीर समझता हैं। पंचायतीराज को ही ले सकते हैं कि जिसमें महिला प्रधान होने पर भी सारे कर्ताधर्ता पुरुष ही रहते हैं। महिला को ये भी पता नहीं रहता कि उनका दायित्व क्या है और हमारा निर्वाचन क्यों हुआ हैं। आखिर वो जाने कैसे? जब घर में चकला-बेलन ही चलाना है। जब कभी एकाध बार कोई ग़रीब व वंचित महिला बगावत कर घर के दहलीज़ को पार करती है, तो पुरुषरूपी घड़ियाल उसको अपने क़ब्जे़ में करने के लिए हर तरह के पैतरे अपनाता है। ये ज़रूरी नहीं कि उसका हथियार केवल पुरुषवादी सोच ही काफी है बल्कि वक्त पड़ने पर एक स्त्री के लिए स्त्री का इस्तेमाल कर लेते है। इस व्यवस्था में मुसहर महिलाओं की स्थिति सोची जा सकती हैं। खुले आम अनुसूचित जाति/अनुसूचित जाति अधिनियम व निवारण एक्ट की धज्जियॉ उड़ रही है। अस्पृष्यता उन्मूलन एक लम्बा संघर्ष है। जब हमारे ग्रामीण समाज की गंदी सोच ही दर्शन बन जाये तो हमारा संविधान व कानून मात्र केवल कागज की कठपुतली ही बनकर रह जायेगा। जिसे हम केवल अच्छे दर्शक की तरह देखेगें और एक गंभीर व प्रशंसनीय चित्रकथा की भाँति अपने मस्तिष्‍क के अवचेतन भाग के ऊपर छोड़ देगें। ऐसी स्थिति में इस समुदाय का क्या होगा?

अंततः हम यही कह सकते हैं कि ये केवल बड़ागाँव के मुसहरों की कहानी नहीं है बल्कि आज देश में यह जाति जहां भी है वहाँ ये कुरूतियाँ व्याप्त हैं। क्या अब भी हम यहीं कहेगें कि समाज सर्वोच्च शिखर पर पहुँच रहा है। उत्तर प्रदेश उत्तम प्रदेश बन गया है?

Kolkata, Jan 21 (IANS) Welcoming the active and vocal support of rights bodies for Binayak Sen's immediate release, his mother Friday exuded confidence that the collective demand of well-wishers will force the government to release him.

'Several rights bodies across the country are demonstrating and demanding my son's immediate and unconditional release. I do believe that all their efforts will collectively stimulate a wave upon the government to release Binayak,' Anusua Sen told IANS over phone.

A day before Christmas, the Raipur district and sessions court found Binayak Sen, 59, and vice-president of the People's Union for Civil Liberties, guilty of sedition and links with Maoists. He was sentenced to life imprisonment, drawing widespread condemnation including from Amnesty International.

'I still have some faith within myself that they (governments) will not be able to keep him behind bars for long, but we have to wait for some more time,' Anusua said.

She also said that her family was looking forward to Jan 24, when the hearing for his bail petition is likely to be held at Chhattisgarh High Court.

'We are all waiting for the outcome of the hearing. I would have liked to be physically present, but my younger son and Binayak's wife Illina asked me to stay back because of my ill health,' she added.

The bail petition was filed earlier this month.

Terming the arrest of Dalit activist Sudhir Dhawale as suppression of freedom of speech and the Dalit movement, a group of activists have demanded his release.

Home minister RR Patil has ordered an independent review by an inspector general followed by further action in the next 8 days.

Working in the tribal and naxal-hit areas in the backwards districts of Vidarbha, Dhawale was arrested by Gondia police under the Unlawful Activities (Prevention) Act and charged with sedition.

The social and Dalit movement activists have formed a 'Sudhir Dhawale Release Movement' that would raise voice overhis arrest in at least 8 districts in the next few days. The movement has the support of noted activist and documentary film maker Anand Patwardhan, Prakash Reddy, Anandraj Ambedkar, writer Urmila Pawar, Pratima Joshi. They were the part of the group that met the home minister.

They claimed that the police have falsely implicated Dhawale. "He was arrested under the charge of sedition, the charges under which freedom fighters were arrested by Britishers decades ago. He was arrested because he possessed the books related to Marxism and Maoism," said Patwardhan.

Indian authorities must release 14-year-old held in Kashmir without charge

Amnesty International has urged authorities in the Indian state of Jammu and Kashmir to release a 14-year-old child who has been detained without charge or trial for seven months, for allegedly taking part in anti-government protests.

The authorities claim that Mushtag Ahmad Sheikh was part of a large crowd which threw stones at police and security forces in the state capital Srinagar in April, as part of the ongoing unrest in Kashmir.

Police say that Mushtag Ahmad Sheikh is 19-years-old but his family claim that he was born in 1996 and is 14-years-old. Prison records reportedly confirm that he is a child.

"Mushtaq Ahmad Sheikh must either be charged with a recognizable criminal offence or released immediately," said Sam Zarifi, Amnesty International’s Asia-Pacific Director.

"If he is charged, he should be treated in accordance with the UN Convention on the Rights of the Child, held and tried in special facilities for children."

Mushtaq Ahmad Sheikh was first arrested in Srinagar on 9 April. He was released on bail after eight days in custody and rearrested on 21 April.

His family was not officially told that he had been detained but found out about it through a local resident.

Initially held at Udhampur Jail, Mushtaq Ahmad Sheikh is now held at Kot Bhalwal Jail in Jammu.

Both prisons do not have special facilities for detaining children. Prison Conditions in Jammu are harsh with limited health care.

In May, Amnesty International raised Mushtaq Ahmad Sheikh's detention at a meeting with the Chief Minister of Jammu and Kashmir and the State Human Rights Commission. To date, despite their assurances, nothing appears to have been done.

Mushtaq Ahmad Sheikh is detained under the Jammu and Kashmir Public Safety Act – a law that allows the authorities to hold people for up to two years without any judicial review.

This year, at least 322 people are reported to have been detained without trial under the act. A number of them, including children, have been detained on similar grounds of stone throwing and rioting during protests against the Indian government.

Over the summer demonstrators in Jammu and Kashmir voiced their concerns about the lack of accountability of the security forces; the withdrawal of the Armed Forces (Special Powers) Act (AFSPA) and the removal of Army camps – along with the underlying demand of independence for Kashmir.

Amnesty International today called on the Egyptian authorities to immediately release a blogger who the authorities continue to hold despite his completion of a four year prison sentence.

Kareem Amer, who was jailed for criticizing President Hosni Mubarak and Islam on his blog, is being held at a State Security Intelligence (SSI) detention centre in Alexandria despite being due for release on 5 November.

Lawyers from the Arabic Network for Human Rights Information (ANHRI) reported that he has been beaten and abused by State Security Intelligence (SSI) officers.

"Kareem Amer has already served his sentence of four years, which in itself was handed down for actions that amounted to no more than exercising his right to freedom of expression, and yet he remains detained." said Amnesty International.

"The Egyptian authorities need to investigate allegations of beatings and other ill-treatment, and explain on what legal grounds Kareem Amer is now being detained."

Kareem Amer was beaten by a junior SSI officer who threatened him in order to stop him writing about Islam and Christians. The officer also threatened to extend Amer’s original detention sentence.

Kareem had initially understood that he was being taken to the SSI office merely to complete the release papers.

In 2007, Kareem Amer was convicted of "inciting strife and defaming Muslims on the internet by describing the Prophet of Islam and his comrades as murderers, which disturbs national peace", and "insulting the President of the Republic by writing on the internet".

In November 2008, the UN Working Group on Arbitrary Detention (WGAD) declared Kareem Amer's detention "arbitrary" on the grounds that being arrested for online criticism and for exercising his right to freedom of expression violated freedoms guaranteed under the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights.

Prison guards had previously assaulted Kareem Amer and also placed him in solitary confinement for allegedly assaulting another inmate, in October 2007.

"The Egyptian authorities have persisted in persecuting Kareem Amer, and others like him, for criticising the Egyptian government," said Amnesty International

Amnesty International said it considers Karim Amer to be a prisoner of conscience and continues to campaign for his release.

Amnesty International also called on President Hosni Mubarak to curb the powers of the SSI and ensure that SSI officials who breach the law or are responsible for abusing prisoners are brought to justice.

India: Chhattisgarh authorities must immediately release Prisoner of Conscience Kartam Joga

Amnesty International has been closely following the case of Kartam Joga, an adivasi (Indigenous) political activist who has been imprisoned in the central Indian state of Chhattisgarh. 40-year-old Kartam Joga has been in Dantewada district jail since 14 September 2010.

Amnesty International considers Kartam Joga to be a Prisoner of Conscience and that the charges brought against him are politically motivated and a pretext to detain him on account of his political activism which has never involved the use or advocacy of violence. The organization believes that the authorities in Chhattisgarh decided to imprison and charge him in response to the Supreme Court criticism

The organization believes that the real reason for Kartam Joga’s imprisonment is his peaceful political activities as an activist of the Communist Party of India (CPI) and an elected member of a local self-government body and his defence of human rights of adivasi communities.

In 2007 he had participated in petitioning India’s Supreme Court regarding human rights violations in Chhattisgargh and impunity for security forces and Salwa Judum, widely held to be a state-supported militia who were involved in operations against the armed Maoists in the Bastar region of the state since 2005.

The charges against him include collaborating with the Maoists in ambushing and killing 76 Central Reserve Police Force (CRPF) personnel on 6 April 2010, murdering a leader of the ruling Bharatiya Janata Party (BJP) Budhram Sodi in May 2010, killing the father of a special police officer attached to the CRPF in August 2010, and ambushing a truck and killing four persons on 7 December 2009.

Kartam Joga’s arrest and the bringing of these charges came after India’s Supreme Court, on 31 August 2010, criticized the Chhattisgarh government for being “wholly vague and indefinite” while replying to several questions raised by two petitions filed three years ago seeking an end to impunity and violations by the Salwa Judum and the security forces engaged in operations against the armed Maoists in Chhattisgarh since 2005. The first of the two petitions had been filed by Kartam Joga and two other CPI activists, and the second, by sociologist Nandini Sundar, historian Ramachandra Guha, and E.A.S. Sarma, a former civil servant.

The charges against him and his imprisonment are another glaring example of how the authorities in Chhattisgarh target those who have sought to consistently defend the human rights of the adivasi communities since 2005.

Two other human rights defenders in Chhattisgarh – medical doctor Dr Binayak Sen and cinematographer TG Ajay – spent two years since 2007 and three months in 2008 respectively in jail on charges of collaborating with the Maoists before they were released on bail. In May 2009, another human rights defender Himanshu Kumar, and some staff of his organization, Vanvasi Chetna Ashram, which continued to document the violations and abuses against the adivasi communities, had to flee the Bastar area after persistent harassment by the police and district authorities.

Kartam Joga underwent medical treatment and an operation for injuries he received when he was attacked by members of the Salwa Judum’s militia in 2005. Since then, he has been in the forefront of documenting and exposing human rights abuses against adivasis, including more than 500 unlawful killings and instances of sexual assault, rape and burning down of adivasi hamlets and houses and the displacement of more than 30,000 adivasis during the conflict in Chhattisgarh since 2005.

Acting on the petitions filed by Kartam Joga and others, the Supreme Court, in April 2008, directed India’s National Human Rights Commission to ascertain the veracity of the allegations; eight months later, an NHRC report confirmed some of the allegations and said there was a need for further investigation into the complaints of violence perpetrated by the Salwa Judum, the security forces and Maoists. Three months later, the Supreme Court asked the Chhattisgarh authorities to list the measures it had taken to disband the Salwa Judum militia, register and investigate complaints of violent acts during the conflict, and compensate and rehabilitate the victims.

The Supreme Court has now asked the Chhattisgarh government to file a comprehensive affidavit in response to the allegations made in the petitions. In On a specific point made by the petitioners that the Salwa Judum militiamen were acting as part of a new organization, Dandakaranya Shanti Sangharsh Samiti, the state authorities have claimed that the Salwa Judum “no longer exists” and that the investigations into its violence were hampered by difficult terrain, inaccessibility of villages, inclement weather and hostility from the Maoists. A further hearing in the case is due on 18 November.

Amnesty International has been closely following the case of Kartam Joga, an adivasi (Indigenous) political activist who has been imprisoned in the central Indian state of Chhattisgarh. 40-year-old Kartam Joga has been in Dantewada district jail since 14 September 2010.

Amnesty International considers Kartam Joga to be a Prisoner of Conscience and that the charges brought against him are politically motivated and a pretext to detain him on account of his political activism which has never involved the use or advocacy of violence. The organization believes that the authorities in Chhattisgarh decided to imprison and charge him in response to the Supreme Court criticism

The organization believes that the real reason for Kartam Joga’s imprisonment is his peaceful political activities as an activist of the Communist Party of India (CPI) and an elected member of a local self-government body and his defence of human rights of adivasi communities.

In 2007 he had participated in petitioning India’s Supreme Court regarding human rights violations in Chhattisgargh and impunity for security forces and Salwa Judum, widely held to be a state-supported militia who were involved in operations against the armed Maoists in the Bastar region of the state since 2005.

The charges against him include collaborating with the Maoists in ambushing and killing 76 Central Reserve Police Force (CRPF) personnel on 6 April 2010, murdering a leader of the ruling Bharatiya Janata Party (BJP) Budhram Sodi in May 2010, killing the father of a special police officer attached to the CRPF in August 2010, and ambushing a truck and killing four persons on 7 December 2009.

Kartam Joga’s arrest and the bringing of these charges came after India’s Supreme Court, on 31 August 2010, criticized the Chhattisgarh government for being “wholly vague and indefinite” while replying to several questions raised by two petitions filed three years ago seeking an end to impunity and violations by the Salwa Judum and the security forces engaged in operations against the armed Maoists in Chhattisgarh since 2005. The first of the two petitions had been filed by Kartam Joga and two other CPI activists, and the second, by sociologist Nandini Sundar, historian Ramachandra Guha, and E.A.S. Sarma, a former civil servant.

The charges against him and his imprisonment are another glaring example of how the authorities in Chhattisgarh target those who have sought to consistently defend the human rights of the adivasi communities since 2005.

Two other human rights defenders in Chhattisgarh – medical doctor Dr Binayak Sen and cinematographer TG Ajay – spent two years since 2007 and three months in 2008 respectively in jail on charges of collaborating with the Maoists before they were released on bail. In May 2009, another human rights defender Himanshu Kumar, and some staff of his organization, Vanvasi Chetna Ashram, which continued to document the violations and abuses against the adivasi communities, had to flee the Bastar area after persistent harassment by the police and district authorities.

Indian government should ensure torture law meets international standards

Amnesty International has urged the Indian government to help end the routine torture of those held by police and prison authorities by ensuring the new Prevention of Torture Bill in India, 2010 meets international standards before adopting it.

The Bill, which is expected to be considered by the Select Committee of the Upper House (Rayja Sabha) of the Indian Parliament on 17 October, will address many forms of torture routinely employed by Indian police and prison officials. The Bill was passed by the Lower house (Lok Sabha) on 6 May 2010.

"If India is serious about its aspiration to be a regional and global power, it needs to address the issue of torture and ensure that the human rights of those it arrests and detains are protected," said Madhu Malhotra, Amnesty International's Asia-Pacific Deputy Programme Director.

Amnesty International said the Bill must be amended to bring it in line with international standards, including limiting torture to practices causing physical suffering, keeping a six-month deadline for making complaints about torture and not annulling current provisions which allow law enforcement officials and security forces virtual immunity against prosecution for perpetrating torture and recommends solutions.

Torture in state detention is endemic in India, involving a range of practices including shackling, beatings and the administration of electric shocks. Disadvantaged and maginalized groups including women, Dalits, Adivasis and suspected members of armed opposition groups are those most commonly abused.

According to official reports, 127 people died in police custody in India in 2008-09, although the figure could be higher since several states failed to report such deaths.

Torture is also reportedly widespread in prisons. The National Human Rights Commission registered 1,596 complaints of torture of prisoners in 2008-09. The number of deaths due to torture is not routinely reported.

The vast majority of cases of torture inflicted on detained people in India are unlawful and punishable under current Indian law, however prosecutions are extremely rare.

Law enforcement personnel enjoy virtual immunity from prosecution for torture and other human rights abuses, and prosecutions remain sporadic and rare.

In "disturbed areas", such as Jammu and Kashmir and the north-eastern states where the Armed Forces Special Powers Act is in effect, Armed Forces personnel enjoy additional immunity protection and there is virtually no accountability for violations.

In 1996, the Indian Supreme Court issued specific guidelines to authorities safeguarding detainee's rights in all cases of arrest or detention, however they are seldom enforced.
There is also a lack of effective systems to independently monitor the conduct of the authorities with regards to torture and other forms of mistreatment.

The Prevention of Torture Bill in India, 2010 is meant to bring India closer in line with the United Nations Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. India signed the Convention in 1997 but has yet to ratify it.

"The Indian government should adopt this Bill to help address key issues, but more needs to be done to ensure India is able to meet international conventions against torture," said Madhu Malhotra.

"The Indian government further needs to ratify the UN Convention Against Torture ensuring people are no longer mistreated while they are detained."

India must address forced evictions and other human rights abuses in Delhi during Commonwealth Games

The Commonwealth Games cannot be used as an excuse to forcibly evict seasonal vendors, street-based workers and beggars, Amnesty International said today.

Thousands of seasonal vendors and street-based workers are facing joblessness as the police prevent them from working on the streets during the Games. The majority of people who have been evicted are being placed in makeshift collective shelters with the residents complaining that these lacked water and sanitation and were not suitable for habitation.

This continues the trend of forced evictions of the poor and marginalized carried out by the local authorities in Delhi in the run up to the start of the Commonwealth Games on 3 October.

Amnesty International received information that the authorities carried out a series of forced evictions in Okhla and neighbouring areas and roads linking the city with its north-eastern parts on the banks of river Yamuna where the Games infrastructure including many stadia, flyovers and bridges were erected in the last few months.

Human rights organisations in India said 2,500 persons and 150-200 families were forcibly evicted from the suburban town of Gurgaon and central Delhi respectively during the last two weeks before the start of the Games.

Amnesty International is concerned that a high number of evictions during August and September appear to have been carried out without safeguards required under international law. In particular, there was no genuine consultation with the people who were evicted. They were not provided with adequate prior notice. The makeshift collective shelters that the authorities have provided, in several instances, do not meet requirements for adequacy of housing under international standards. Some people have not been provided with any alternative housing.

The Indian authorities have a duty to ensure that alternative housing is provided which complies with international standards. They must also provide effective remedies to all those who have been forcibly evicted.

Amnesty International therefore urges the Indian authorities to:

•ensure that evictions are carried out only as a last resort, and only in full compliance with requirements under international human rights standards;
•ensure that those who have been evicted are provided with adequate alternative housing and/or land to undertake their livelihoods as a matter of urgency;
•ensure that any alternative housing that is provided complies with requirements for adequacy of housing, under international human rights standards; and
•provide all victims of forced evictions with access to effective remedies.

Indian authorities must also address the growing number of labour rights abuses and violations of labour laws practised by various state agencies and private firms involved in construction activities, despite the efforts of a four-member committee appointed by a directive of the Delhi High Court to monitor such violations.1 These violations, documented by India’s human rights organizations, included irregular registration, denial of statutory minimum wages, equal payment of wages to women workers and statutory health benefits, poor safety standards leading to deaths of workers in accidents and occasional use of child labour.

There is no denying that child marriage still exists in this modern world, but more and more girls have started resisting early matrimony in favour of further studies.

VARANASI: Teleserial 'Balika Badhu' may appear to be a replay of an era long gone by, but it is not so. There are areas and communities that still go for much earlier weddings of their children than allowed by the law. However, there is also no denying the fact that children, especially girls, have started resisting child marriage and-- what is more-- are getting support of their parents in opting for studies than matrimony.

"My parents wanted to get me married four years ago when I was just 13. But, I protested and convinced them that I wanted to pursue my studies. This is Vimla, a 17-year-old girl from a low caste Musahar community where child marriage is a normal affair, mostly due to acute poverty.

Presently, Vimla is a Class XII student and studying in a girls' inter college in Kuwar area. "I want to become a teacher so that I can help my community and dispel the darkness of ignorance," said the girl, whose siblings, including younger sister, were married off in an early age. Her parents-- Motilal Banvasi and Shanti Devi, natives of Kuwar village-- are landless labourers, and they wanted to marry off their minor daughter due to acute poverty.

Similar is the case of Jyoti (16), a native of Hukulganj, who wants to become self-reliant before her marriage. Her father left the family and settled in Mumbai. Her mother Lalmani Devi wanted to marry her daughter three years ago. Currently, Jyoti is studying in Class X. Another girl, Puja (16), a resident of Baghwanala slum, also refused her marriage proposal a year ago and continued with her studies. "My family members wanted to stop my schooling and marry me after Class IX because one the girls of the locality eloped with some boy and they were apprehensive I may do the same. It was ridiculous, and I strongly protested," she said and added finally her father Shiv Kumar Thathera was convinced and came to her aid. "Presently, Puja is studying in Class X and we would marry her according to her wish," said her father.

Two other girls, Chanda (15), a native of Baghwanala slum, and Madhuri (17), a native of Kuwar village, also opposed their early marriage and are continuing with their studies. All these girls belong to the lowest strata of society and live in penury. But, they showed courage to go against the tide and set an example for others. Seeing their determination, a human rights organisation-- Peoples Vigilance Committee on Human Rights (PVCHR)-- is going to honour them at a function on Sunday. "These girls have shown courage to denounce the practice of child marriage, which is not only a social evil but also violation of human rights," said Shruti Nagvanshi of PVCHR.

These girls have set an example as even the Law Commission of India in its report (2008) for proposal to amend the Prohibition of Child Marriage Act, 2006 and other allied laws, admits that child marriages continue to be a fairly widespread social evil in India. In a study carried out between 1998 to 1999 on girls of 15-19 years of age, it was found that 33.8 per cent were currently married or in a union. Referring to the National Family Health Survey of 2005-2006 (NFHS-3), carried out in 29 states, the report says 45 per cent of women-- currently between 20-24 years-- were married before the age of 18. The percentage was much higher in rural areas (58.5%) than in urban areas (27.9%) and exceeded 50 per cent in eight states. The percentage of women between aged 20-24, married by the time they were 18, stood at 61.2 per cent in Jharkhand followed by 60.3 per cent in Bihar, 57.1 per cent in Rajasthan, 54.7 per cent in Andhra Pradesh and 53 per cent in MP, UP and West Bengal.

The NFHS-3 findings further revealed that 16 per cent of women, aged 15-19, were already mothers or pregnant at the time of the survey. It was also found that more than half of Indian women were married before the legal minimum age of 18, compared to 16 per cent of men aged 20-49 who were married by the age of 18. Though, NFHS-3 did not compile any data on girls who were married below the age of 15, the 2001 Census had revealed that 3,00,000 girls under 15 had given birth to at least one child.

Early marriage is often linked to low levels of schooling for girls. NFHS-3 figures show that 71.6 per cent of Indian women, currently aged 20-24 years, who had been married before the age of 18 years, did not have any education at all. Furthermore, by not going to school, young brides were denied the opportunity to make friendships with peers or acquire critical life skills. Child marriage below a certain age is blatant child abuse. The Indian Penal Code considers any sexual intercourse with a minor wife below 15 years of age rape.

What keeps demon of child marriage alive

Varanasi: The phenomenon of child marriage can be attributed to a variety of reasons. The chief among them being poverty and culture, tradition and value-based on patriarchal norms.

According to the report of the Law Commission of India, the marriage of a minor girl often takes place because of poverty and indebtedness of her family. Dowry becomes an additional reason, which weighs even more heavily on poorer families. The general demand for younger brides also creates an incentive for these families to marry the girl child as early as possible to avoid high dowry payments for older girls.

The girl in patriarchal set-up is believed to be a burden. These beliefs lead parents to marry the girl child. Unfortunately, the patriarchal mindset is so strong that the girl has no say in decision making. Texts like Manu Smirti which state that the father or the brother, who has not married his daughter or the sister who has attained puberty, will go to hell, are sometimes quoted to justify child marriage. Child marriages are also an easy way out for parents who want their daughters to obey and accept their choice of a husband for them. There is also a belief that child marriage is a protection for the girls against unwanted masculine attention or promiscuity. In a society, which puts a high premium on the patriarchal values of virginity and chastity of girls, girls are married off as soon as possible.

The report says the child marriage is a grave violation of the rights of the child, depriving her of opportunities and facilities to develop in a healthy manner to obtain education and to lead a life of freedom and dignity. It deprives the young girl of capabilities, opportunities and decision-making powers and stands in the way of her social and personal development. Young brides face the risk of sexual and reproductive ill health because of their exposure to early sexual activity and pregnancy. Complications and mortality are common during childbirth for young pregnant girls. Girls who come from poor backgrounds, and who are often married at an early age, have little or no access to health care services. Risks associated with young pregnancy and childbearing include an increased risk of premature labour, complications during delivery, low birth-weight and a higher chance that the newborn will not survive.

The report further says young mothers, under age 15, are five times more likely to die than women in their 20s due to complications. Maternal mortality among adolescent girls is estimated to be two to five times higher than adult women. Maternal mortality among girls aged 15-19 years is about three times higher. Young women also suffer from a high risk of maternal morbidity. Research indicates that the babies of mothers below the age of 18 tend to have higher rates of child morbidity and mortality. Infants of mothers younger than 18 years have a 60 per cent greater chance of dying in the first year of life than those of mothers aged 19 years or older.

According to the report, young brides also run the risk of catching diseases from their respective spouses, as older husbands often engage in sexual relations with other women outside the marriage. Young married girls do not have bargaining power in the marriage and therefore cannot negotiate safe sex and are deemed vulnerable. It has also been found that young girls are physiologically more prone to contracting HIV/AIDS, as their vagina is not well lined with protective cells and the cervix may be more easily eroded. An analysis of the HIV epidemic shows that the prevalence of HIV infection is highest in girls between 15-24 and peaks in men between five to ten years late

Myanmar: Political prisoners must be freed

On the third anniversary of the violent crackdown on the “Saffron Revolution”, Amnesty International calls on the Myanmar government to immediately and unconditionally free all political prisoners arrested for their peaceful activism.

The Myanmar authorities continue to imprison over 2,200 political prisoners—more than double the number held before the August 2007 protests against sharp fuel and commodity price rises.

“While the international community, including Myanmar’s ASEAN neighbours, has been calling for free, fair and inclusive elections there, the plight of thousands of political prisoners has been overlooked,” said Benjamin Zawacki, Amnesty International’s Myanmar Researcher.

Amnesty International believes the vast majority of those held are prisoners of conscience who are being punished merely for peacefully exercising their rights to free expression, assembly and association.

The Myanmar government will hold its first elections in 20 years on 7 November 2010 against a backdrop of political repression and systematic violence. Under Electoral Laws enacted in March 2010, no political prisoner can take part in the elections or hold membership in any political party.

International attention in recent months has focused on the power-play between the military and the government’s proxy parties on the one hand; and the armed ethnic minority groups, the National League for Democracy, and a small number of new opposition parties on the other.

“The long-standing problem of political imprisonment in Myanmar remains very much at the heart of the political impasse in the country”, said Benjamin Zawacki. “These prisoners constitute a significant part of the political opposition”.

In the largest show of public discontent against the military government in Myanmar since the 1988 pro-democracy uprising, tens of thousands of protesters—led by Buddhist monks—took to the streets in August and September 2007, demanding economic and political reforms.

The peaceful country-wide demonstrations were violently put down by the authorities in late September 2007. At least 31 (and possibly more than a hundred) people were killed—with many more injured and at least 74 disappeared—and thousands detained.

The brutal crackdown provoked international condemnation, including an unprecedented expression of revulsion and demands for change from the UN Security Council, the UN Human Rights Council and the Association of South East Asian Nations (ASEAN).

Yet even as Myanmar prepares for its first elections in two decades, as part of what it calls a “Roadmap to Democracy”, it continues to repress political opposition.

“It beggars belief that the government can attempt to burnish its democratic credentials by holding elections, while it also holds more than 2,200 political prisoners behind bars and out of sight of the campaigns and polls”, said Benjamin Zawacki . “The international community should point out to Myanmar that these practices cannot be reconciled under any genuine Roadmap to Democracy”.

Political prisoners in Myanmar are held in deplorable conditions.

Many of those who took part in the Saffron Revolution, such as labour rights campaigner Su Su Nway, monk leader and activist U Gambira, and 88 Generation Student group members Min Ko Naing, Htay Kywe, Mie Mie, Ko Mya Aye and Zaw Htet Ko Ko, are in poor health. In the past two years, at least 238 political prisoners have been moved to extremely remote prisons, restricting their access to relatives, lawyers and medical care. Reports of torture and other ill-treatment are rife. The International Committee of the Red Cross has been denied access to prisons in Myanmar since late 2005.

“On this third anniversary of the Saffron Revolution, Amnesty International calls on world leaders to demand that the Myanmar government free all political prisoners at once, and ensure human rights protection throughout the elections period and beyond”, said Benjamin Zawacki.
